1.The applicant will, at any time subsequent to placing the drainage tile, and as long as the tile exists, and at his own expense, relay or reconstruct the tile as may become necessary to protect it from new grades or alignment, resulting from maintenance or construction operations by the county. The applicant agrees to do this promptly upon order by the county, without cost to the county. If the applicant is unable to comply promptly, the county may cause the work to be done, and the applicant will pay the cost thereof upon receipt of statement.

2.The applicant shall take all reasonable precautions, during the construction, to protect and safeguard the lives and property of the traveling public and adjacent property owners by the use of proper signs, barricades, flag persons and lights, and shall save harmless the county from any and all suits, actions, or claims of any kind or nature brought because of any injuries or property on account of the use or occupancy of the highway right-of-way.

3.The county will assume no responsibility for damages to the applicant’s drainage tile occasioned by any construction or maintenance operations on said highway, subsequent to commencement of construction. The applicant shall indemnify and hold the Miner County, its Highway Department, its officers, agents, and employees, harmless from and against any and all actions, suits damages, liability or other proceedings of any kind or nature brought because of any injuries or damage received or sustained by any person or property on account of the use or occupancy or right-of-way designated in this application.

4.The applicant agrees, on unpaved roads, an open trench may be dug and the drainage tile placed therein in a solid non perforated pipe of adequate strength and of sufficient length to extend eight (8) feet beyond each edge of the road surface, and the trench back-filled over the tile. All back-filling of tunnels and trenches shall be thoroughly compacted to the original density to avoid settling. All work shall be done in a workmanlike manner and the ground left in a neat condition. On paved roads, tile may be placed by boring only; cutting of the pavement is not allowed. Tiles shall be placed in casings so that the line may be removed for repair or replacement without disturbing the subgrade or base of road, also to prevent water leaks from eroding and penetrating the roadway. The casing shall be of adequate strength and of sufficient length, to extend eight (8) feet beyond each edge of the surfaced roadway.

5.The applicant will be responsible for any repairs to the road subgrade and road surface resulting from placement or maintenance of such tile.
