As required by Section 11526 of Part 115, Solid Waste Management, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended.

Failure to submit this form will prohibit the affected jurisdiction from exporting solid waste to Michigan for disposal.

Failure to submit this form willprohibit Michigan landfills from receiving solid waste for disposal from the affected jurisdiction.

Section11526a(1)(c)of Part115 prohibits the owner or operator of a landfill from accepting for disposal in this state solid waste that was generated outside of this state unless the country, state, province, or local jurisdiction in which the solid waste was generated is approved by the MDEQ for inclusion on the list compiled by the MDEQ under Section 11526b. Section 11526b(2) provides that a country, state, province, or local jurisdiction that demonstrates equivalent disposal prohibitionsshall be included on the list prepared by the MDEQ if they:
  1. Provide the MDEQ with documentation that the country, state, province, or local jurisdiction prohibits from disposal in a landfill the items prohibited from disposal in a landfill located in this state, or
  2. Prevent from disposal in a landfill the items prohibited from disposal in a landfill located in this state through enforceable solid waste disposal requirements that are comparable to this part.
Such documentation must include all pertinent statutes, administrative regulations, and ordinances.

I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I further certify that I am fully authorized by the governmental jurisdiction of the landfill to submit this report. Should the signatory find at any time after submittal of the requested information that any portion of the submittal certified as true is false or misleading, the signatory shall immediately notify the MDEQ, providing any corrections, explanations, or additional information necessary.
