Procedure: At least forty-five (45) days prior to the commencement of any construction, an application and any plans for modification shall be submitted to the Architectural Control Committee (Committee). Within thirty (30) days after receipt of the application, any plans and all other required information, the Committee shall notify the Owner in writing as to whether the request has been approved. If the Committee has not given a response within thirty (30) days, the application for alteration shall be deemed approved.

Submittals: The thirty (30) day time period for response will be restarted if the Committee does not have all the information it needs to review the application. Please submit any of the following materials that may relate to this proposed alteration and may help the Committee conduct their review. These may include:
Plans/Specifications indicating material, size and use of the proposed alteration.
Physical survey or Plat indicating the location and dimensions of the proposed alteration.
Photograph(s) of the existing conditions.
Illustration, brochure picture or photograph(s) of any new elements in the proposed modification.
Contractors name and address.
Please provide up to four (4) signatures of adjacent or visually affected neighbors if possible. Acknowledgement of neighbors(s) indicates awareness of alteration and not approval or dismissal.

WARNING: Exterior alterations commenced without prior approval of the Committee are in violation of the Master Declaration of Covenants, Conditions and Restrictions for Eagle Creek Golf Community (Covenants).
Agreement: By purchase of property in Eagle Creek Golf Community, each owner has agreed to adhere to the restrictions outlined in the Deeds, Plats, Covenants and the most recent revision of Design Standards promulgated by the Committee. By signing this application, you hereby confirm that you are the Owner of the lot and that the proposed alteration will conform to all of said restrictions. These include in part that;
- No more than 30% of any lot will be covered by any impervious structures, including asphalt, gravel, concrete, brick, stone, slate or similar material, not including wood decking or the water surface of swimming pools.
- No hardened structures such as fences, accessory buildings, etc…, will be placed within drainage easements along Guinea Mill and Rowland Canals.
- Owners are responsible for the contractors they hire to perform work on their property.
- Any vegetation disturbed during construction will be repaired to the satisfaction of the Committee.
- You are current in your association dues.
Furthermore, all alterations and construction methods shall conform to local, state and federal regulations. Any permits and/or licenses required by Currituck County or any other governmental authority shall be obtained by the Owner or Owner’s representative and shall be posted at the site prior to the commencement of construction. The Committee reserves the right to enter upon any lot in order to investigate compliance with the approved application for alteration. Also within thirty days of completion of the project, you are required to contact the ACC (Committee) to ensure compliance with the requested alterations. We can be reached at . - If approval with conditions is granted and construction then begins, the conditions shall be deemed accepted by the Owner of the Improved Lot and the imposed conditions shall become fully a part of the approved Plans.
- A request for additional information shall be deemed a determination that the information submitted was inadequate, and the thirty (30) day time period for further Committee response shall only commence upon receipt of the requested additional information.
- Any Owner submitting Plans to the Committee and disagreeing with the finding of the Committee may appeal the decision to the Board by giving written notice of the appeal to the President of the Association within fifteen (15) days following the receipt of notice of denial.
