Another Child’s Treasure Seller Agreement
In consideration for the opportunity to participate in and profit from ACT, d/b/a Another Child’s Treasure the undersigned seller agrees to the following:
1.Seller agrees to hold harmless and make no claim against ACT d/b/a, Another Child’s Treasure, its proprietors, the owners or leasers of the space where the sale operates, any volunteer and paid participants in Another Child’s Treasure sale, or the insurer of ACT for the damage, theft or loss of any items consigned through the ACT sale. Another Child’s Treasure does not anticipate any thefts, damage or loss and takes every precaution to prevent them.
2.Seller agrees to waive any and all claims for personal injury resulting from participation in Another Child’s Treasure sale from any cause, foreseen or unforeseen against ACT, its proprietors, the owner or leasers of the space where the sale operates, any volunteer or paid participants in ACT, or the insurer of ACT.
3.Volunteers will be needed before, during, and after the sale. Once scheduled, ACT relies on its volunteers to keep their commitment of working their scheduled shift. If a person is uncertain of committing time to work a shift, PLEASE do not schedule to work. We certainly appreciate all those who offer their time.
4.Seller agrees to the tagging system set forth by ACT, and acknowledges that not complying with this system shall forfeit the approval of items for sale through ACT.
5.All merchandise left in the possession of ACT, d/b/a Another Child’s Treasure, are at the sole risk of the seller. Seller agrees that it shall assume and bear all risks regarding consigned merchandise, and will hold Another Child’s Treasure, exemptfrom any and all liability; to include but not limited to theft, fire, wind, or rain. In addition, ACT reserves the right to remove any items from the sale due to wear, poor condition, seasonally inappropriate, and/or stain. Items remaining at the sales location after 6pm on Saturday, October 6, 2010 will be donated at the discretion of ACT, d/b/a/Another Child’s Treasure.
6.Seller gives permission to ACT that all items with no price indicated on the tag will be sold for fair market price to be determined by Another Child’s Treasure if contact cannot be made between ACTand seller. Seller agrees to accept this as a final price for the item. If a price cannot be reasonably determined, then the item will not be sold.
7.Seller agrees that an item with no price indicated on the tag or missing a tag will not be sold however, placed in the lost and found area. ACT will make every effort to restore lost tags to the correct item using the “description” seller has placed on tag. Any items remaining in the lost and found area after 6pm on Saturday, October 6, 2010 will be donated at the discretion of ACT.
8.Seller agrees that no claims will be made against ACT, d/b/a Another Child’s Treasure, for any discrepancies involving items placed in the sale.
9.Seller agrees to cash checks issued as proceeds from the sale within 60 days.
Additional checks will not be issued for any reason.
