ANNUAL REPORTING REQUIREMENTS

Each State chartered savings bank is required by 7 T.A.C. §76.4 and Finance Code Section 96.053(a) to prepare annually a statement of its financial condition as of the last business day of December of the preceding year. Enclosed are the forms to be used for your annual statement of financial condition as of December 31, 2012. The statement of financial condition is to be prepared in accordance with the guidelines set forth in 12 CFR §304.3 of the FDIC Rules and Regulations for savings banks; therefore, it should match the end of year CALL Report, with one exception: a break out of any investment in subsidiaries, instead of consolidating.

The statement of condition, properly executed, together with Page 2, Page 3 (Subsidiary Survey) and Page 4 (Branch Survey), should be forwarded to this Department NOT LATER THAN MARCH 1, 2013. We request that one copy be approved and made a part of the minutes of a meeting of the institution's Board of Directors. The report may be mailed or scanned and emailed to the Department at 2601 North Lamar, Suite 201, Austin, TX 78705, or to .

We have also included a sheet containing the State Savings Bank Emergency Contact Information that we have for your bank. Please review the information that we have, make any corrections, and return to the Department along with the report. Additionally, if there are no corrections to be made, please affirm that the information we have is correct. As we expect with our personal telephone numbers and personal email addresses, your information will be held confidentially within the Department.

Please use the following guidelines when completing the attached forms: (PLEASE NOTE: The file has been changed to an Excel spreadsheet to improve the ease of number entry and increase uniformity. The attached four pages are simply examples of each worksheet in the Excel spreadsheet that you will receive by email.)

  1. The address to be shown for the institution is that of the Home Office.
  1. Please indicate the state savings bank charter number given to your institution, not the insurance certificate number from the Federal Deposit Insurance Corporation. The charter date may be the date of becoming a savings bank charter or may be the original insurance date, if converted from another existing financial institution.
  1. The number of authorized branches report on page 1 should include all operating branches, as well as branches approved but not operating at this time. The number should not include the home office, or any administrative office, loan or deposit office, mobile facilities, remote service units, or agencies.
  1. Include both operating subsidiaries and service corporations on Page 3.
  1. To maintain consistency throughout the annual reports, please do not change the formatting in the Excel columns. If you are providing your numbers in thousands, please include the three zeros after each number. The "Other Capital Accounts" caption should be used to report unrealized gains and losses on available for sale securities, etc.
  1. The names of the Board of Directors should be typed, not signed personally by the Directors.
  1. The certification at the bottom of the form must be signed by the President or Managing Officer certifying the information is true and correct.
  1. Publication of the statement of condition in a newspaper of local circulation is not required.
