ANNEXURE TO TENDER ENQUIRY FOR SPORADIC SERVICES TO UNDERTAKE MATERIAL HANDLING WORKS

1)Submission of Bids:

a)The bids/quotations shall be valid for a period of 120 days from the date of opening.

b)Bidders may note that except the Demand Drafts all other documents are to be uploaded through e-procurement system only. However, scanned copies of the Demand Drafts drawn towards tender fee/EMD shall be uploaded in to the e-procurement system along with the bid.

c)Earnest Money Deposit / Bid Security: Bidders are required to submit Earnest Money Deposit (EMD) for an amount of Rs. 1,00,000/- [Rupees One Lakh Only] in the form of Demand Draft drawn in favour of Accounts Officer, SDSC SHAR, SRIHARIKOTA and to besent by post to Sr. Purchase & Stores Officer, Tender Section, SCF Purchase, SDSC SHAR, Sriharikota – 524 124 before due date. On the cover containing the DDs, Tender No. and due date must be mentioned. EMD/Bid Security of unsuccessfulBidders shall be returned to the bidders at the earliest after the finalization of the Tenderwithout any interest. The EMD of the successful bidder will bereturnedwithout any interest, after the receipt of performance Security fromthem as called for in the contract. EMD/Bid security shall be exempted to thoseBidders who are registered with the National Small Industries Corporation (NSIC)Or Micro, Small Enterprises (MSEs). They are required to attach electronically self attested copy ofRegistration Certificate along with the bid. Without receipt of EMD/NSIC/MSE attested Registration Certificates, the offer will not be considered even though the offer was sent electronically. SDSC SHARshall not entertain any correspondence in this regard after opening of the Tender.The EMD/Bid Security will be forfeited if the Bidders withdraws oramends, impairs or derogates from the tender in any respect during the periodbetween Tender due date and tender finalization. No separate order orLetter would be issued for forfeiture of EMD/Bid Security which follows ondefault and shall be credited at once to the Government Account.

d)The total price arrived so as per Annexure – I to be fed/quoted electronically and also the Annexure-I duly filled and signed to be attached electronically to the bid. Bids without the attachment of Annexure-I will be rejected summarily.

e)Declaration shall be submitted as per Annexure II. Bids received without Annexure-II will be rejected summarily.

f)Minimum Wages, EPF contribution, Insurance premium and Service Tax element in the Price Bid are fixed and Bidder shall quote only Service Charges (all inclusive as detailed under “h” below) applicable per day per worker.

g)Service Charges shall only be in terms of fixed amount per worker per day and the same shall be firm and fixed during the entire currency of the contract. The bidder shall not quote Service Charges in terms of percentage or in any other manner. No additional Service Charge shall be payable in case of Revision of Wages.

h)The Service Charges to be quoted by the Service Provider/bidder shall be reasonable. SDSC SHAR reckons various elements like Transport charges,interest on payment of wages to be disbursed in advance, Income Tax deduction (TDS), interest on EMD/Security Deposit, Administrative charges for EPF/Insurance coverage/Service Tax, expenditure towards shoes, gloves, first aid kit etc., while determining the reasonableness of Service Charges/quote/offer.

i)SDSC SHAR reserves the right to reject any unreasonable/conditional offer without assigning any reasons.

j)The documents attached/uploaded along with the tender are sacrosanct for considering any offer as a complete offer. It is, therefore, important that all documents duly completed and signed and attached, failing which tender is liable to be treated as incomplete and ignored.

k)Bids without any consideration i.e. if zero is quoted towards service charges/profit, such bids will not be considered.

2)Instructions to Bidders:

a)Quotations received without DDs for EMD/Tender Fee shall not be entertained under any circumstances. Bids received electronically but without DDs for EMD/Tender Fee and DDs received towards EMD/Tender Fee after due date & time shall not be entertained under any circumstances. If the bidder is registered with NSIC/MSE, EMD will be exempted if the bidder attaches a self attested NSIC/MSE Registration Certificate to the bid.

b)The documents attached/uploaded along with the tender are sacrosanct for considering any offer as a complete offer. It is, therefore, important that all documents duly completed and signed and attached, failing which tender is liable to be treated as incomplete and ignored.

c)SDSC SHAR shall not be responsible for non-receipt of DDs due to postal delay / loss in transit.

d)No request for the extension of the due date for any reason shall be considered.

3)Evaluation of Bids:

a)SDSC SHAR shall determine the substantial responsiveness of each bid to the Bidding Documents. For the purpose of these Clauses, a substantially responsive bid is one which conforms to all the terms and conditions of the Bidding Documents without any deviation.

b)A bid determined as not substantially responsive shall be rejected by SDSC SHAR.

c)During the evaluation of the bids, SDSC SHAR shall ask any Bidderto produce the Originals of the documents attached for verification. Any failure in this regard by the bidder shall be entitled for gross rejection of their Bid.

d)Comparison of the price bids shall be done on the basis of Service Charges quoted by the bidders as all other elements in the Price Bid are fixed.

e)SDSC SHAR reserves the right to award the contract to TWO Service Providers. The required manpower shall be divided among the Service Providers as decided by SDSC SHAR. The Service Provider who offered the lowest Service Charge which is reasonable as envisaged in Para 1 (h) above shall be treaded as L1 offer. The Service Charge offered by L1 shall be counter offered to all other qualified Service Providers asking to match L1 rate. Those Service Providers who are willing to accept L1 rate shall be kept in a panel in the order of their original quote. The contract shall be awarded to L1 and first service provider in the panel.

f)In case of any exigencies like termination/short closing of any of these contracts or any other reason before its expiry, SDSC SHAR shall award a parallel contract to the next service provider in the panel for remaining period of the contract or any period as decided by SDSC SHAR. This arrangement shall be at the discretion of SDSC SHAR and no Service Provider can make any claim in this regard as a matter of right.

g)In case of a tie in the Service Charges between two or more Service Providers, seniority shall be decided by taking lots.

h)Notwithstanding anything stated above, SDSC SHAR reserves the right to assess bidder’s capability and capacity to perform the contract. Shall the circumstances warrant, such assessment in the overall interest of SDSC SHAR & decision of SDSC SHAR in this regard shall be final. SDSC SHAR reserves the right to reject any or all tenders or cancel/withdraw the notice inviting tender in whole/part without assigning any reason whatsoever and decision in the matter shall be final & binding. In such case no bidder shall have any claim arising out of such action.

4)Eligibility Criteria:

a)The Service Provider should have executed at least two similar nature of contracts worth Rs. 10.00 lakhs or above for supply of workers/manpower to ISRO Centres/Units or any other reputed organisations/establishments during the last 5 years. Scanned copies of orders executed shall be attached to the bid with work completion certificate. Bids without the scanned copies of orders executed and work completion certificates will be rejected.

5)Scope of work:

a)SDSC SHAR is looking for a qualified, reputed and well established Contractor/Service Providerwho has the potential to enter into Contract to undertake sporadic services for material handling works as detailed below.

b)The work involves opening of packages, segregation of materials, removing of materials from boxes, assistance in checking and also stacking the materials for inspection.

c)Loading and unloading of consignments, equipments, furniture, stationery, common stock items, gas cylinders and other materials/consignments into/from trucks, trolleys and handing over the same to indenters and unloading of items collected from suppliers/facilities/divisional stores. Loading and unloading of rejected/ unserviceable items at specified places and arranging them in lots.

d)Shifting of various materials such as equipments, machinery, furniture, raw materials and stationery from one division to another and other related shifting/loading/unloading labour works etc.

e)Shifting of files to record rooms, tying of files, arranging files in order, movement of files from one office to other office, loading of files/records to vehicles and unloading, helping in records weeding etc., and any other labour job assigned by the Contract Manager from time to time.

f)The daily requirement of workers as on date shall be a maximum of 17. The number may vary/decrease depending upon the work load. The Contract Manager shall intimate the Service Provider the required number of workers from time to time.

g)The number of workers required shown above is indicative only. No guarantee can be given as to the definite number of workers required at any time or during the period of the contract. The requirement of workers is purely depends upon the activities of the SDSC SHAR. The number of workers requirement may increase/decrease as per the requirement of SDSC SHAR activities and the service provider shall provide the required number of workers as and when requested.

h)Contractor shall also ensure that the workers provided are having good physique for carrying labour works, discipline, honesty and maintain decency and decorum at all times. The workers should abide by the rules and regulations issued by the organization from time to time especially those regarding safety, security and confidentiality. SDSC SHAR shall have the right to advise the Service provider to terminate the services of any worker for any violation of security provisions and/or for indiscipline/violent behavior, agitation, instigating other peaceful works. In case of such advice, Service provider shall comply with the same immediately.

i)SDSC SHAR reserves the right to increase or decrease or withdraw workers in part/full without assigning any reason.

j)The Service Provider shall not be allowed to transfer, assign, pledge or sub-contract its rights and liabilities under this contract to any other agency.

k)The Service Provider shall identify a coordinator who would be responsible for immediate interaction with the SDSC SHAR so that optimal services of the workers deployed by them could be availed without any disruption.

6)Period of Contract:

a)The contract shall initially be for a period of one year from the date of award of contract unless it is curtailed or terminated by SDSC SHAR owing to deficiency of service, breach of contract, reduction or cessation of the job requirements etc. The contract shall automatically expire unless extended further by mutual consent.

b)The contract may be extended for a further period of one year mutually agreed upon by both the parties on the same terms and conditions except the minimum wages which shall be fixed by SDSC SHAR.

7)Responsibilities of the Service Provider:

a)The Service Provider shall ensure deploying of workers who are capable of performing the nature of work as mentioned in the scope of contract, at the specified stores, viz., SPROB Stores, VAST Stores and RO/LSSF Stores by 08:55 hrs. in the morning.No transport will be provided by SDSC-SHAR.

b)The Character and Antecedents of the workforce shall be got verified through record check by the Service Provider/Contractor from the concerned Police authorities and the Original Police Report shall be submitted to the Contract Manager.

c)Bio-data and two passport size photograph of each candidate shall be sent to the Contract Manager for arranging entry pass/record.

d)The Service Provider shall have his First Aid Kit at the designated place in SDSC SHAR for the use of his workers.

e)The workers, once approved for the service, shall not be changed without the prior concurrence of the Contract Manager.

f)The Services of workers will be required from Monday through Friday with eight hours per day. The Service Provider shall ensure availability of the workforce on all working days. However, in case of any requirement for services of such workers on Saturdays, Sundays and Public Holidays and beyond/before office hours, the payment will be made on pro-rata basis.

g)In case of any revision of wages during the currency of the contract, there shall be no change in the Service Charges/Profit margin payable to the Service Provider.

h)In case, the person(s) deployed by the Service Provider commits any act of omission/commission that amounts to misconduct/indiscipline/incompetence, the Service Provider shall be liable to take appropriate disciplinary action against such persons, including their removal from the duty. The Service Provider shall replace any of its workers who is/are found unacceptable to SDSC SHAR because of security risks, incompetence, conflict of interest, improper conduct or for any other reasons, immediately upon receiving instructions from the Contract Manager.

i)Service Provider/Contractor should provide to the workers good quality safety shoes and hand gloves as required for the nature of work of the contract. SDSC SHAR shall not be held responsible for any injuries, loss of limbs, loss of life of the contractor’s workers, due to non-compliance to the safety norms/requirements. Contractor has to include the expenditure towards this in his service charges and quote the Service Charges/Profitaccordingly.

j)The Contractor/Service Provider repeatedly violates the terms and conditions of the contract or fails to provide services required despite SDSC SHAR having served them notices, the contract shall be liable to be terminated and security so deposited shall be forfeited.

k)SDSC SHAR reserves the right to terminate the contract without assigning any reason by giving a prior notice of 30 days.

8)Parallel / Adhoc Contract:

a)SDSC SHAR reserves the right to enter into parallel/Adhoc contract(s) with one or more Contractors/Service Provider(s) during the currency of the contract for availing the same or similar services.

b)In order to identify more than one Contractor/Service Provider, SDSC SHAR reserves the right to award the contract to any other Contractor/Service Provider who has qualified in the subject tender and willing to provide the services.

9)Financial:

a)The wages for the workers shall be fixed by SDSC SHAR. At present the minimum wage for the unskilled workers is Rs. 315/-

b)SDSC SHAR shall reimburse payment towards Employer’s contribution towards EPF as per the prevailing rates on minimum wages. SDSC SHAR shall reimburse payment towards insurance premium as decided by SDSC SHAR. Employee’s contribution towards EPF and insurance premium to be borne by the workers and SDSC SHAR shall not pay any contribution towards this.

c)SDSC SHAR shall pay applicable Service Tax as per the prevailing rates.

d)Service Charges: SDSC SHAR shall pay the agreed upon Service Charges to the Service Provider. The Service Provider shall quote the Service Charges only in terms of fixed amount per person per day and the same shall be firm and fixed during the currency of the contract. The Service Provider shall not quote the Service Charges in terms of percentage or in any manner.

e)The Service Provider shall make the payment to workers deployed not later than 7th of succeeding month through ECS/bank. Payment shall be made within 7 days of receipt of the Invoice/Bill duly certified by the Contract Manager and approved by Head, Purchase and Stores. The Invoice/Bill along with all supporting documents like (i) proof of payment of wages made for the preceding month, proof of remittance of EPF contributions and Insurance premium made for the preceding month including the statements containing the name of the worker, Account No., Contribution paid and (ii) Service tax paid, shall be submitted on or before 10h of the following month.

f)The Service Provider shall issue a signed wage slip to the personnel containing details such as number of days present, wages payable, recoveries made, etc.

g)In case the Service Provider fails to make the payment to the workforce deployed by 7th of the succeeding month as mentioned above and not remitted the amount related to Insurance premium and EPF contributions to the concerned authorities, SDSC SHAR reserves the right to make alternative arrangements for such payments and recover the amount so paid from the Service Provider either by deduction from any amount payable to the Service Provider under the work order/service contract or any other work order/service contract placed on the Service Provider by SDSC SHAR or as a debt payable by the Service Provider, and no notice shall be issued for such payment by SDSC SHAR.
