ORDINANCE NO. 16-01
AN ORDINANCE OF THE TOWN OF INDIALANTIC, BREVARD COUNTY, FLORIDARELATING TO CHAPTER 5; AMENDING SECTION 5-2 RE-NAMING “ORLANDO” PARK TO “TIM DERATANY ORLANDO” PARK; PROVIDING A SEVERABILITY AND INTERPRETATION CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, parks within the Town of Indialantic are provided names for identification and ease of locating by those interested in using the park; and
WHEREAS, park names may represent a physical location and/or a particular individual; and
WHEREAS, the subject property lies west of S. Ramona Avenue between Ormond Drive and Orlando Blvd.; and
WHEREAS,Council desires to re-name the park in honor of Tim Deratany whowasinstrumental in the initial development of the park and who was involved in the development of the Town as a private citizen and as its Mayor for seven years;
NOW, THEREFORE, BE IT ENACTED by the Town Council of the Town of Indialantic, Brevard County, Florida:
SECTION 1. That Sec. 5-2 of the code of ordinances of Indialantic, Florida is hereby amended to read:
Sec. 5-2. Hours of operation.
The following parks shall remain open to the public from 6:00 am until 9:00 pm: Dewey, Ernest Kouwen-Hoven Riverside, Gus Carey, IndialanticOceanBeach (south of Lot 20, Block 38, Indialantic by-the-Sea, Plat Book 3, Page 35, Public Records of Brevard County, Florida), Indian River, Lily, Tim DeratanyOrlando, SeaPark, Sunrise, Tradewinds, Vincent Benevente Sunset,Wavecrest and Wavecrest Extended. Douglas Park shall remain open to the public from 5:00 am until 10:00 pm. NancePark and IndialanticOceanBeachPark (which runs from NancePark to the southern boundary of Lot 20, Block 38, Indialantic by-the-Sea, Plat Book 3, Page 35, Public Records of Brevard County, Florida) shall remain open to the public from 6:00 am to 1:30 am.
SECTION 2. Severability/Interpretation Clause
(a) In the event that any term, provision, clause, sentence or section of this Ordinance shall be held by a court of competent jurisdiction to be partially or wholly unenforceable or invalid for any reason whatsoever, any such invalidity, illegality, or unenforceability shall not affect any of the other or remaining terms, provisions, clauses, sentences, or sections of this Ordinance, and this Ordinance shall be read and/or applied as if the invalid, illegal, or unenforceable term, provision, clause, sentence, or section did not exist.
(b) In interpreting the provisions of this Ordinance, the following rules and symbols shall apply:
(1) Words underlined are additions to existing text.
(2) Words stricken through are deletions from existing text.

(3) Asterisks (* * *) indicate a deletion from the Ordinance of text existing in the Code of Ordinances. It is intended that the text in the Code of Ordinances denoted by the asterisks and not set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this Ordinance.
SECTION 3. Effective Date. This Ordinance shall become effective immediately upon adoption.
PASSED by the Town Council of the Town of Indialantic on the first reading the _____day of ______, 2015, and ADOPTED by the Town Council of the Town of Indialantic, Florida on the final reading on the ______day of ______, 2015.
