ORDINANCE NO. 2015 -
AN ORDINANCE OF THE MAYOR AND THE CITY COMMISSIONOF THE CITY OF HALLANDALE BEACH, FLORIDA RATIFYING THE ADMINISTRATIVE ORDER IMPOSING A SIX MONTH ZONING IN PROGRESS MORATORIUM FOR THE ISSUANCE OF DEVELOPMENT ORDER FOR ANY HOTEL DEVELOPMENT TO ALLOW A COMPREHENSIVE REVISION TO THE ZONING AND LAND DEVELOPMENT CODE REGULATIONS PERTAINING TO HOTELS; PROVIDING FOR AN EFFECTIVE DATE AND ALL OTHER PURPOSES.
WHEREAS, the Mayor and the City Commission have requested that City Administration examine and study the City’s land development regulations relating to limits on the number of hotel rooms that could be developed on a given plot of land (“hotel density”); and
WHEREAS,pursuant to the authority given to the City Manager in Section 8-36 of the Code of Ordinances of the City of Hallandale Beach, an Administrative Order was released on April 16, 2015, establishing a six month zoning in progress moratorium on the issuance of any development orders for the placement, construction, or expansion of a hotel; and
WHEREAS,during the moratorium, the City Administration will perform a comprehensive review and make revisions to the zoning and land development code regulations pertaining to such hotels; and
WHEREAS, Section 8-36 requires that the City Commission hold a public hearing to determine whether or not the administrative order issued by the City Manager should be ratified, modified or reversed; and
WHEREAS, Section 32-966(g)(2) authorizes the City Commission to restrict the issuance of permitsthat would result in a nonconforming use of property if proposed changes were made for the six months period; and
WHEREAS, a public hearing was held on May 6, 2015, and after consideration of all the evidence presented, the Mayor and City Commission finds that the six month zoning in progress moratorium is reasonably necessary for a detailed comprehensive analysis of hotel development within the City of Hallandale Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF HALLANDALE BEACH:
SECTION 1. Ratification of Six Month Zoning in Progress Moratorium. The Mayor and the City Commission hereby ratify the Six month zoning in progress moratorium initiated by the City Manager on hotel development within the City of Hallandale Beach as being reasonably necessary to allow a comprehensive analysis of hotel development within the City of Hallandale Beach.
SECTION 2.Effective Date. This Ordinance shall take effect immediately upon its adoption.
