AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF WEBER COUNTY GOVERNING PARKING

WHEREAS, the Board of Weber County Commissioners passed Chapter 4 of Title 42 on September 6, 2016 to provide an administrative process to handle parking violations; and

WHEREAS, the Sheriff’s Office has identified additional parking ordinances in Title 32 that should be included in Chapter 4 for the sake of consistency; and

NOW THEREFORE, the Board of County Commissioners of Weber County amends, removes, and enacts ordinances as follows:

Sections 3 and 4 of Chapter 8, Title 32 shall be removed entirely as follows:

Sec. 32-8-3. - Vehicle parking on county roads during and after snow storm.

In order to adequately remove snow and to avoid property damage as far as possible, it is necessary to keep the county roads clear of all parked vehicles and other obstacles stationed on or adjacent to the travelway. Therefore, when snow removal becomes necessary, no person who owns or has possession, custody, or control of any vehicle or other object shall park or place such vehicle or object upon or immediately adjacent to any street travelway between 4:00 a.m. and 12:00 noon of any day, except authorized emergency service personnel. Any such vehicle or object so parked or placed, is declared a public nuisance.

Sec. 32-8-4. - Removal of public nuisance vehicles.

The county sheriff is hereby authorized to abate any public nuisance vehicle or object by moving, removing, or causing to be removed or by impounding said vehicle or object. For every vehicle so impounded a written report shall be forwarded to the county sheriff's office, with a description of the vehicle, date, time, and place of removal, the reason for the removal, and location where vehicle is stored.

The following sections shall be enacted and added to Title 42, Chapter 4:

Section 5 of Chapter 8, Title 32 shall be renumbered to Section 3 of Chapter 8, Title 32.

Chapter 9 and Chapter 10 of Title 32 shall be removed in their entirety as follows:

CHAPTER 9. – PARKING IN WEBER INDUSTRIAL PARK

Sec. 32-9-1. - Parking on public streets within Weber Industrial Park prohibited.

No owner, lessee, purchaser, operator or possessor of any vehicle or trailer shall park or leave such vehicle or trailer on any public street within the boundaries of the Weber Industrial Park. Any such vehicle or trailer so parked is declared a public nuisance and may be abated in accordance with section 32-8-4.

CHAPTER 10. – PARKING AT GEERTSEN BAY

Sec. 32-10-1. - Parking on the public pathway in the area of Geertsen Bay prohibited.

No owner, lessee, purchaser, operator or possessor of any vehicle or trailer shall park or leave such vehicle or trailer on any public pathway within the posted areas of Geertsen Bay. Any owner, lessee, purchaser, operator or possessor of any vehicle who parks in a posted area is guilty of an infraction and shall be subject to a fine not exceeding $20.00.

The following sections shall be enacted and added to Title 42, Chapter 4:

Sec. 42-4-2.1 – Parking after a snow storm.

When snow removal becomes necessary, no person who owns or has possession, custody, or control of any vehicle or other object shall park or place such vehicle or object upon any highway between 4:00 a.m. and 12:00 p.m., except for authorized emergency service vehicles.

Sec. 42-4-2.2 - Parking on public streets within Weber Industrial Park prohibited.

No owner, lessee, purchaser, operator or possessor of any vehicle or trailer shall park or leave such vehicle or trailer upon any highway within the boundaries of the Weber Industrial Park.

Sec. 42-4-2.3 - Parking on the public pathway in the area of Geertsen Bay prohibited.

No owner, lessee, purchaser, operator or possessor of any vehicle or trailer shall park or leave such vehicle or trailer on any public pathway within the posted areas of Geertsen Bay.

This Ordinance shall be effective 15 days after publication of a synopsis in the Standard Examiner.
