AN ORDINANCE AUTHORIZING THE VACATION, DISCONTINUANCE

AND STRIKING FROM THE CITY'S GENERAL PLAN OF STREETS OF

A PORTION OF LEONARD STREET IN THE FIFTEENTH (15th )WARD OF THE

CITY OF BETHLEHEM, COUNTY OF NORTHAMPTON, PENNSYLVANIA.

WHEREAS, a Petition of the owners of all the properties abutting that portion of Leonard Street to be vacated hereby has been presented to the Council of the City of Bethlehem requesting said vacation; and

WHEREAS, the City Planning Commission at its meeting of September 8, 2005, recommended to City Council the vacation of Leonard Street between Lebanon Street and Woodbine Street.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF BETHLEHEM HEREBY ORDAINS AS FOLLOWS:

SECTION 1. That that portion of Leonard Street between Lebanon Street and Woodbine Street as hereinafter described be, and the same is, hereby vacated, discontinued, abandoned and stricken from the City's General Plan of Streets:

ALL THAT CERTAIN portion of a street known as Leonard Street between Lebanon Street and Woodbine Street situate in the Fifteenth (15th) Ward, City of Bethlehem, County of Northampton, Commonwealth of Pennsylvania, more particularly bounded and described as follows; to wit:

BEGINNING at a point in the intersection of the west street line of Lebanon Street, a street fifty feet (50.0’) wide, and the south street line of Leonard Street, a street twenty feet (20.0’) wide, thence extending along the south street line of Leonard Street South eighty-seven degrees twenty-seven minutes West (S 87º 27’ W) two hundred thirty-fie and fifteen one-hundredths feet (235.14’) to a point, thence North sixty-one degrees West (N 61º W) one hundred twenty-four and sixty-seven one-hundredths feet (124.67’) to a point, thence North twenty-nine degrees East (N 29º E) twenty feet (20.0’) to a point, thence South sixty-one degrees East (S 61º E) one hundred and seventeen feet more or less (117’+/-) to a point, thence North eighty-seven degrees twenty-seven minutes East (N 87º 27’ E) two-hundred thirty-three feet more or less (233’+/-) to a point, thence South two degrees thirty-three minutes East (S 2º 33’ E) twenty feet (20.0’) to the point, the place of beginning.

BOUNDED on the North by lands of the Bethlehem Housing Authority, on the East by Lebanon Street, on the South by lands of the Bethlehem Housing Authority and on the West by Woodbine Street.

ALL of which is shown on the plan entitled “Plan of Land to be acquired by the Bethlehem Housing Authority for State Subsidized Housing Project No. 2 Fairmount Village, Bethlehem, PA, Scale 1”-50’, dated July 14, 1950, Leonard M. Fraivillig Co. Engineers, Bethlehem, PA”, a copy of which is on file in the City Engineer’s Office.

SECTION 2. The City Planning Commission’s approval of the vacation of that portion of Leonard Street described above is conditioned upon the following:

  1. Access shall continue to be provided for the existing housing units to the south of Leonard Street.
  1. The existing number of off street parking spaces accessed via Leonard Street shall be retained or relocated in close proximity to the existing dwellings.

SECTION 3. That upon final enactment of this Ordinance, the City Engineer be and he hereby is, authorized, empowered and directed to strike from the City's General Plan of Streets that portion of Leonard Street described in Section 1 hereof as public streets of the City of Bethlehem.

SECTION 4. All Ordinances and parts of Ordinances inconsistent herewith be, and the same are hereby repealed.
