Tariff Preference: Amendment to CIP (12) 51 Autonomous Trade Preferences for Pakistan

1. Introduction

European Parliament and Council Regulation 1029/2012 introduced special autonomous preferences for 75 products originating in Pakistan. Details of the products concerned can be found in Annexes I and II to this paper. For 26 of the products (Please see Annex II) the autonomous preferences are available only within the limits of annual first come first served tariff quotas. The preferences are available for the remaining products (In Annex I) without any quota restrictions.

The special autonomous preferences, which take the form of nil preferential rates of duty, will apply to eligible productsthat areexported from Pakistan, and released to free circulation in the EU on or after 15 November 2012; which meet the appropriate preferential rules of origin; and which are covered by a valid proof of preferential origin issued in Pakistan.

The autonomous preferences will expire at midnight on 31 December 2013.

The Regulation contains safeguard clauses to protect EU industry in the textiles, clothing and ethanol and leather sectors against surges in cheap imports. The EU Commission may remove the products concerned from the scope of the special preferences before 31 December 2013 if the level of their imports from Pakistan grows by 25% or more in 2012 or 2013.

2. OrigiN rules

In order to benefit from the autonomous preferences, the products concerned must meet the GSP Standard Beneficiary Country rules of origin in Notice 830.

Products manufactured in Pakistan from materials, components or parts which have originated in the EU in accordance with the GSP rules of origin, will qualify for the preferences, provided that the processing undertaken in Pakistan on the materials etc is more than minimal.

Products manufactured in Pakistan under the Regional Cumulation arrangements described in paragraph 3.4.2 of Notice 830 will not qualify for the preferences.

3. Documentary requirements

All claims to the autonomous preferences, both in and outside of the quota restrictions, must be supported by a valid GSP Form A issued in Pakistan bearing the special endorsement in Box 4:

“Autonomous measure - Regulation (EU) No. 1029 /2012”.

If the GSP Form A accompanying the goods does not have the above endorsement in Box 4, the standard GSP rate of duty must be claimed, and you must not make a claim to the quotas.

4. Making claims to the autonomous preferences

(a) Claims for eligible products not covered by quota restrictions

Claims to the autonomous preferences must be made by inserting:

  • country code PK in Box 34
  • tariff rate A in box 47c of the customs import declaration;
  • code 300 in Box 36;
  • document code U065 in Box 44together with the appropriate status code for the availability of the GSP Form A containing the special endorsement; and

(b) Claims to quota

Claims to the autonomous preferences on goods covered by the first come first served tariff quotas must be made by inserting:

  • country code PK in Box 34
  • tariff rateA in box 47c of the customs import declaration;
  • code 320 in Box 36;
  • document code U065 in Box 44together with the appropriate status code for the availability of the GSP Form A containing the special endorsement: and
  • the appropriate Tariff Quota Order Number (See Annex II) in Box 39 (NB The Tariff Quota Order number must be inserted in the box in every case where the products concerned are covered by a GSP Form A bearing the autonomous measure endorsement).

As the quotas are new, and they have therefore been in operation for less than two years, they will be set at critical under the provisions of EU legislation. Therefore, you will have to provide security for the full nonGSP rate of duty payable on the products when making the claim to quota.

The EU Commission will not make an allocation against the quotas until 29 November2012.

Ifa particular quota is exhausted at the time of release of the goods, you will be able to make, subject to the satisfaction of all normal conditions,a regular claim to Pakistani Preference under the GSP. This means that in most cases you will have to pay a reduced preferential rate of duty on the products concerned. You will be able to use the endorsed GSP Form A which has been issued in Pakistan under the special autonomous arrangements to support the regular claim. However, you or your agent/forwarder will have to insert the following information in the customs import declaration in order to obtain the standard GSP rate of duty.

  • Country code PK in Box 34
  • Code 200 in Box 36
  • tariff rate G in box 47c of the customs import declaration;
  • document code N865 together with the additional status code for the availability of the GSP Form A

5. Retrospective claims

HMRC can only consider retrospective claims to the autonomous preferences on eligible productswhich were exported from Pakistanon or after 15 November 2012, and which are covered by a retrospectively issued GSP Form A bearing the special endorsement in Box 4

If you have already paid the full or standard GSP rate of customs duty on eligible products which were exported from Pakistan on or after 15 November 2012, you should send the endorsed retrospectively issued GSP Form A with a claim for repayment (on Form C285) to:

Please note that the Pakistani authorities will not be able to issue the endorsed GSP Forms A for goods exported before 15 November 2012, as there is no legal basis for them to do so.
