15. WARRANTY PROVISION:
15.1. Air Quality Analytical, Inc. ("AQA") d.b.a. Gasmet-USA warrants that the Equipment described herein will comply with the Specifications, and will be free from defects in materials and workmanship for a period of one (1) year after date of shipment (the "Warranty Period").
15.2. During the Warranty Period, AQA will, following written notice of any defects in materials or workmanship from the Buyer, either
(i) repair or replace any nonconforming equipment FOB Austin, TX (8310 Cliffsage Ave., Austin, TX 78759), buyer to pay all shipping charges and ship in original shipping container(s); or
(ii) repair or replace any nonconforming equipment at Buyer's site or at the site where the Equipment is otherwise located, buyer to pay technician labor rate, per-diem and all travel expenses plus 5% of travel expenses.
Title to nonconforming Equipment being shipped to AQA shall pass to AQA when delivered to AQA place of business and title to the repaired or replacement Equipment shall pass to the Buyer when delivered by AQA to the shipping carrier for return to the Buyer.
If any Equipment is shipped to AQA or AQA dispatches its personnel to a Buyer's site and the applicable Equipment is determined either to comply with the Specifications or to have been damaged or misused other than through the fault of AQA, the Buyer shall pay AQA's normal, customary charges in connection therewith.
15.3. During the Warranty Period, AQA will provide phone support at no charge to Buyer (other than Buyer's long distance or other phone charges incurred by Buyer) during regular business hours (8:00 a.m. to 5:00 p.m., central time), North American Continent only, scheduling may be subject to availability.
15.4. SELLER WARRANTS THE GOODS TO BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP IN NORMAL USE AND SERVICE. EXCEPT FOR WARRANTY OF TITLE AND WARRANTY OF MERCHANTABILITY AND FITNESS FOR THE PARTICULAR PURPOSE DESCRIBED HEREIN; NO OTHER WARRANTIES (WHETHER EXPRESSED, IMPLIED OR STATUTORY) ARE MADE BY SELLER.
AQA MAKES NO WARRANTIES OTHER THAN THE EXPRESS WARRANTIES IN THIS STATEMENT OF WARRANTY AND NONE SHALL BE IMPLIED. THE ENTIRE OBLIGATION OF AQA FOR EQUIPMENT MALFUNCTIONS OR DEFECTIVE INSTALLATIONS AFTER ACCEPTANCE IS AS EXPRESSLY STATED IN THIS WARRANTY STATEMENT. IMPROPER OR FAULTY INSTALLATION MAY VOID THE WARRANTY.
