Assumption of Risk and Release of Liability

Whereas, the undersigned (“the applicant”; hunter) wishes to be accepted for participation in a hunting experience that the applicant has requested to participate in, that certain risks and dangers may occur. These include but are not limited to traveling on open waters, traveling into and through wetland environments, hunting with other hunters with firearms, and forces of nature. The undersigned further recognizes that these risks may also include loss or damage to personal property, and physical damage and/or injury not excluding fatality due to accidents which may occur while hunting and/or travel to and from the act of hunting. The undersigned further understands that participating in the requested hunting activities, that there will be exposure to the effects and elements of nature, including temperature extremes and inclement weather.

I certify that I am healthy and capable of participating in this type of hunting experience. I understand that it is solely my responsibility to determine whether there is any medical reason that I should not participate in this hunting experience.

In consideration of, and as part payment for the right to participate in such a hunting experience and other services arranged for me, I have and do hereby assume all of the associated risks and any other ordinary risk incidental to the nature of the hunting experience which are not specifically foreseeable, and will hold harmless from any and all liability, actions, causes of action, debts, claims and demands of every kind and nature whatsoever, whether for bodily injury, property damage or loss or otherwise, which I now have or which may arise from or in connection with this hunting experience. Therefore, I release Reedy Creek Outfitters, LLP, Raymond Jr. and Jennifer Bukowski, John and Sally Stoneham, Brian and Lori LaFay, and all the above officers, employees, agents, and/or associates, and their heirs, executors, administrators, successors and assignees and for all members of my family including any minors accompanying me. In short, I cannot sue the above mentioned parties and if I do I cannot collect any money. In addition, I will be liable for all attorney and court fees associated with any litigation pertaining to this agreement.

I fully understand that my hunting experience involves physical activity, which may result in the risk of injury and/or fatality. I enter into this experience and take full responsibility for any decision to participate in the entirely voluntary activity.
