Summary Suspension: License, certificate or registration of a person is suspended without a hearing if the Board finds there is a substantial danger to the public health or safety which warrants this action. Simultaneously, proceedings are instituted for a hearing before the Board.
Mandatory Suspension: Upon receipt of documentation by a court or agency, state or federal, that a licensee of the Department of Health Professions has been convicted of a felony or has been adjudged legally incompetent or has had his license, certificate or registration to practice the same profession revoked or suspended in another jurisdiction, the Director of the Department must immediately suspend without a hearing, the license or certificate. Reinstatement requires a hearing before the Board with an affirmative vote of three-fourths of the members of the Board.
Findings of Abuse, Neglect or Misappropriation: Nursing facilities receiving Medicare or Medicaid funds are prohibited by federal law from employing certified nurse aides with findings of abuse, neglect or misappropriation of patient property.
