NOTICE OF APPLICATION FOR LEAVE TO APPEAL (Pursuant to Rule 25 of the Rules of the Supreme Court of Canada)

TAKE NOTICE that the Applicants, Zoë Childs, Andrew Childs, Pauline Childs, Heather Lee Childs and Jennifer Christine Childs apply for leave to appeal to the court pursuant to s. 40(1) of the Supreme Court Act, R.S.C., 1985, c. S-26 as amended, for an order granting leave to appeal from the Judgment of the Court of Appeal for Ontario made on May 19, 2004 in court of Appeal File No. C38836, or such further or other order that the said Court may deem appropriate.

AND FURTHER TAKE NOTICE that this application for leave is made on the following grounds:

1. The Court of Appeal for Ontario erred in law by finding that the relief claimed in this action against the Defendants Courrier and Zimmerman was a novel tort.

2. The Court of Appeal for Ontario erred in law by overturning the trial Judge's finding that a duty of care existed against the Defendants Courrier and Zimmerman. The finding that a duty of care existed is a mixed finding of fact and law by the trial Judge and should only be reversed if the trial Judge mage a palpable and overriding error.

3. The foregoing legal issues are of sufficient public importance to warrant this court's attention because the judgments of the courts below:i. constitute an incorrect departure from the principle that the categories of negligence are never closed.ii. incorrectly state that social host liability is not simply an extension of commercial host liability.iii. constitute a reversal by the Court of Appeal for Ontario of findings of fact and mixed findings of fact and law made by the trial Judge absent any determination that the trial Judge committed a palpable or overriding error.
