NOTICE OF EXPIRATION

OF

RESTRICTIVE COVENANT FOR

WETLAND PRESERVATION AREA

This Notice of Expiration of Restrictive Covenant for Wetland Preservation Area ("Notice of Expiration") is given this day of , , by the undersigned (“Owner”) to the Board of Commissioners of County, Minnesota ("Board of Commissioners"):

A. The Wetland Conservation Act of 1991, as amended, authorizes the establishment of wetland preservation areas pursuant to Minn. Stat.' ' 103F.612.616 and Minn. R. 8420.0400 on eligible lands.

B. Owner holds fee title to the Real Property in the County of (“County”), State of Minnesota described on Exhibit A attached hereto and incorporated by reference ("Real Property").

C. By Restrictive Covenant For Wetland Preservation Area ("Restrictive Covenant") dated and recorded or filed on , as Document No. in the Office of the County Recorder/Registrar of Titles in the County of , State of Minnesota, Owner established a wetland preservation area on the Real Property.

D. The Wetland Preservation area is on the portion of the Real Property identified on Exhibit B attached hereto and incorporated by reference ("Wetland Preservation Area").

E. Pursuant to Minn. Stat. ' 103F.613, a wetland preservation area continues in existence until the owner initiates expiration by notifying the Board of Commissioners of the county where the wetland preservation area is located on a form approved by the Minnesota Board of Water and Soil Resources. The date of expiration must be at least eight years from the date of notice.

F. Owner desires to initiate the expiration of the Wetland Preservation Area established on the Real Property pursuant to the Restrictive Covenant.

NOW, THEREFORE, the Owner gives the following notice:

1. Owner hereby initiates expiration of the Wetland Preservation Area established on the Real Property pursuant to the Restrictive Covenant. The date of expiration ("Date of Expiration") shall be eight years from the date on which the Board of Commissioners received this Notice of Expiration. The date on which the Board of Commissioners received the Notice of Expiration is stated in the attached Affidavit of Receipt of Notice of Expiration.

2. All benefits and limitations of the Wetland Preservation Area and the Restrictive Covenant shall cease on the Date of Expiration.
