This is a planning history for Bagby Airfield as of May 2013 and should be read alongside Appendix 2 plan of Bagby Airfield.

Planning permission granted to Mr J Whiting for the construction of a light aircraft hangar to be located in OS Field 124 and the use of the grass runway for light aircraft. Conditions restricted number of flights to three in any one week within the hours of 0600 and 2300 and restricted to one specific aircraft, a Jodell D1117.

In April 1976, it was bought to the Council’s attention that the condition relating to the number of flights was exceeding that permitted. This application was submitted with the aim of regularising this breach. Permission was granted 25 May 1976 for increased use of the existing grass airstrip within OS Fields 123,125 and 86 for private flying and was subject to conditions which restricted the use of the airfield to that of aircraft owned by Mr Whiting and Mr Lassey. A condition restricted use of the airfield to 6 take off and 6 landings in any one week and to only be used between the hours of 0600 and 2300.

Permission granted 29 May 1980 for the increase in use of the existing grass airstrip for private flying. Conditions imposed stipulating that the permission was solely for the benefit of Mr Lassey and that all aircraft using the airstrip be in his ownership or shall be there with his authority. On termination of his occupancy of the land the permission would cease to have effect. Condition also imposed restricting movements to 40 take off and 40 landings in any one week and restricted to between the hours of 0600 and 2300.

Permission refused on 20June 1986 for a variation of condition to allow 200 flights per month at the airfield. The proposal was considered unacceptable as it would result in an intensification of the use, which would, due to noise and associated activity would be likely to have a detrimental effect on both the amenity of nearby residential properties and the character of the rural area.

As a response to a letter from the LPA noting that buildings had been constructed on the site without permission, planning application submitted proposing the construction of a clubhouse and 5 hangar buildings. These buildings were proposed in the current locations of Hangars C, D, L, N, and P. Application refused 1 September 1986 it was considered that it would increase the amount of permanent accommodation on the site and therefore increase the amount of traffic visiting the site. It was seen that this would cause annoyance and loss of amenity to occupants of nearby dwellings and that approval would likely encourage further applications to increase the permitted number of flights from the airfield.

Application refused 1 September 1986 proposing the variation of condition to allow for 60 take offs and 60 landings in any 7 day period. The proposal was considered to be unacceptable due to intensification of use which would have a detrimental effect upon the amenity of nearby residential properties and the character of the pleasant rural locality.

Retrospective planning application approved 6 November 1986 for the retention of existing hangar buildings for Mr J P Lassey. These hangars identified on plan as buildings C, D, L, N and P, the same as that applied for and refused in application 2/86/0015C but the approval included a condition to ensure that the buildings were solely for the use of Mr Lassey and that aircraft using the hangar buildings be in his ownership or be there with his authority. Upon termination of his occupancy of the land, “the permission shall cease to have effect and the buildings shall be removed and the ground levelled and be seeded” to the satisfaction of the Local Planning Authority.

An appeal was made against this refusal in 1987.

Application submitted 1 September 1986 and permission granted4 November 1986 for the siting of a portable building for use as an office/aircraft control/facility /toilet/restroom and was conditioned so that on the termination of the use of the land as an airfield the buildings shall be removed and that the premises shall not be used for any other purpose other than as an office/aircraft controlfacility/toilet/restroom.

A condition was also included to ensure that it was solely for the benefit of Mr Lassey and that people using the building should only be there with his authority. The plan accompanying this application shows this building in a location that appears to be that of the current control room/facilities building but is shown as a detached structure. The current plan shows this building to be attached to aircraft/parts storage/workshops known as N and O.

Application refused 26 June 1987 for the construction of an aircraft hangar in the location of aircraft/parts storage/workshop O attached to the southern elevation of hangars known as Hangars L and N. It was considered that the erection of a further building on this site with only personal permission for use as airfield would intensify the use of the site and prejudice the return of the land to agricultural use of the termination of the airfield use under planning consent 2/80/009/0015A.

Appeal against the personal restriction on the use of the buildings as per application 2/86/009/0015E. The inspector found the personal use restriction to be unsound, noting that

‘From my inspection of the site and the surroundings, I am of the opinion that the buildings associated with the activity and the airstrip itself, do not create any harmful intrusion into the open countryside or harm the rural environment. Regarding the activity of recreational light aircraft flying, I am of the opinion that provided the scale of the activity is controlled in terms of the number of flights and operational hours so as not to be harmful to the amenities and interests of local residents, I am not convinced that a further condition personal to the designated individual is essential to the safeguarding of the quality of the rural environment’.

This appeal did not relate to the personal restriction with regards to the approval for the portable building for use as an office/aircraft control/facility/toilet/restroom as per application 2/86/009/0015F.

Planning permission granted 6 May 1988 for the construction of an aircraft hangar, known as aircraft/parts storage workshopO.This was a repeat of application 2/86/009/0015Gthat had been refused due to the concern that an airfield restricted by a personal use condition could not have such a scale of activity and expect that the use would cease upon the cessation of Mr Lassey’s occupancy.

Planning permission granted 1 June 1989 for the installation of an underground fuel storage tank and fuel pump. Condition imposed that it be used solely for the purposes of refuelling of aircraft and that it should only be used for purposes ancillary to the use of Bagby Airfield. Located to the south of the veranda shown X on the plan.

Planning permission granted for the construction of a building for the storage of light aircraft, that shown as Hangar B. Condition imposed to ensure that the building is should not be used for any purposes other than other than the storage of light aircraft, ancillary to the site being used as a private airfield.

The building approved was shown to have a footprint of 500 square feet with a small apron to the front. This building was then constructed larger than approved, with a footprint of 753 square feet (as measured 24 June 2009).

Planning permission granted 10 November 1995 for an agricultural pig building measuring 46m x 9m with a location covering half the footprint of aircraft/parts/storage/ workshop M. Approved for agricultural use only and condition imposed requiring the building to be removed and the land returned to its former state on the cessation of agricultural use.

Planning permission granted 17 May 2006 for an aircraft hangar known as Hangar A (Appendix 1). This hangar was then constructed larger than approved with the addition of an unauthorised ‘lean-to’ to the side of the Hangar, increasing the width by 4.3m. Concrete apron also constructed to the front of the Hangar with no approval. The lean-to achieved approval as part of the 2011 appeals.

Enforcement Notices served in respect of construction of Hangar E with apron, formation of an apron to Hangar A and concreting of a section of the East West runway and also laying of geo-textile matting to the East West runway.

Revised planning application on Bagby Airfield comprising an airfield clubhouse with three bedrooms new/extended hangars with concrete aprons, new workshop/maintenance hangar artificial matting area on main runway relocated fuel line, access and car parking. Refused (subject to appeal, appeal dismissed).

2011The 2011 Appeal considered the Enforcement Notices issued in 2009 and the refused planning applications from 2009 and “The 2010 Scheme”. The decision maintained the status quo, granting retrospective approval for the aircraft hangar, concrete section of the runway and the provision of geo-textile matting that had taken place but refused the comprehensive re-development and other works that had not been implemented.

Enforcement Notices issued. The enforcement notices were issued relating to the use and structures for an Air Ambulance base, use of Hangar A for storage in connection with the operation of unauthorised repair, service and maintenance use (Hangar B and P). A notice was issued in respect of the provision of a septic tank pipe connection to Hangar B to connect to toilet facilities. Notices were issued regarding use of a static caravan for residential purposes, storage of materials, operation of an air taxi (Hangar E) and hire of aircraft (Hangar D and N) and the use of the North South runway (15/33) without planning permission.

Construction of a hangar to accommodate an air ambulance with associated operations, crew room and toilet facilities (Hanger K) Permission refused.

The 2012 Appealconsidered the enforcement notices issued in 2011. The appeals related to both changes of use and operational development. The three appeals relating to the use and structures for an Air Ambulance base (Y) where withdrawn during the Inquiry, the notice in respect of use of a hangar for storage (A) was upheld. The notice in respect of use for repair service and maintenance (B and P) was also upheld. The appeal in respect to the provision of a septic tank connection to Hangar B (Z) and a caravan used for residential purposes was upheld. The notice regarding storage of materials was upheld allowing additional time for compliance. The appeal in respect of the operation of helicopter air taxi (E) was allowed noting that there was no evidence of a breach of control. The appeal in respect of the hire of aircraft (D) was withdrawn. The notice in respect of the use of the North South runway (15/33) was upheld.

2013The 2013 Appeal is to consider the appeal against the enforcement notice relating to use of the East West runway and an unauthorised fuel facility for JetA1 fuel.
