Subject: Public Notification of Draft Environmental Screening Risk Assessment and Risk Mitigation Plan

for Soil and Groundwater Cleanup

Prior to the redevelopment of a 13.5 acre commercial property that will include the development of retail stores, the Browman Development Company (BDC), a corporation, will be implementing focused soil and groundwater remediation for a Property located on the 20400 Block of Hesperian Boulevard, Hayward, CA. A fact sheet discussing environmental concerns and proposed focused remedial and mitigation activities is attached to this notification letter.

Community Meeting

A community meeting will be set if public response warrants. This would be held in a local public place to discuss or learn more about the focused soil and groundwater cleanup and hear about the future commercial development planned for the site. Representatives from the Regional Water Quality Control Board (the cleanup oversight agency) and the development and environmental teams would be on hand to provide more information and answer questions.

20400 BLOCK OF HESPERIAN BOULEVARD

FOCUSED SOIL AND GROUNDWATER CLEANUP

The Browman Development Company (BDC), a Corporation, is planning to redevelop the 20400 Block of Hesperian Boulevard in Hayward, California into commercial retail stores. Prior to redevelopment of the site, BDC plans to perform focused remedial action regarding onsite contaminated soil and groundwater under the oversight of the Regional Water Quality Control Board (CRWQCB). This focused work, required by the CRWQCB, is only a portion of an overall remedial action that will be implemented and required by offsite responsible parties. This effort is intended to meet regulatory guidelines for specific development activities at the site.

As a result of retail fueling activities on and surrounding the site, subsurface soil and groundwater in some areas was found to contain elevated levels of petroleum hydrocarbons as a result of an unauthorized release from both on and offsite sources. The extent of onsite soil and ground water contamination was confirmed during previous soil and groundwater investigations that were conducted in October, 1998 and April, 2004, and during recent investigations in August 2005. The results of the recent investigation are contained in the Draft Environmental Screening Risk Assessment and Risk Mitigation Plan, prepared by The Twining Laboratories, Inc., dated August 17, 2005. A copy of this plan is available for public review and comment at the Hayward Main Library, located at 835 C Street, Hayward, California and at the Water Board website.

Cleanup

A field team from a licensed environmental engineering company will be on site in mid September to implement the Mitigation Measures. To begin redevelopment efforts, contaminated soil and groundwater will be abated in the areas of proposed retail shops as requested by the CRWQCB with focused remediation. Following this focused effort, an existing retail fueling facility will be demolished; this operation will entail removal of exiting underground storage tanks and associated piping. At this point contaminated soil will be excavated from specific areas to depths approved by the CRWCQB. The soil will be removed and disposed of at a permitted disposal facility. Additionally, any contaminated groundwater that is encountered during excavation will be removed and also disposed of at a permitted facility in the affected areas in daylight hours.

The initial focused cleanup is planned to take approximately three weeks and will include drilling equipment and associated support vehicles. Following this effort and at the time of the fueling station demolition, there will be the use of heavy excavation machinery and waste disposal trucks. Field engineers will be on site to oversee the work, monitor dust levels, and take soil and water samples to confirm that the soil and groundwater containing high levels of contaminants have been removed. Best work practices and dust control measures will be used during cleanup. Soil will be loaded into and transported by trucks that are fully licensed and permitted to carry the contaminated soil. Trucks will be decontaminated before leaving the site and covered to minimize dust emissions during transport. The site will remain secured for the duration of these activities. Active site excavation work will be conducted only during daylight working hours between 7:30 a.m. and 5:00 p.m.
