Sir,

This Association requests your immediate intervention for a speedy resolution of the following issues.

1.  It is learnt that ACR’s have been called for in respect of promotions to the grade of Asst Commissioners . As had been represented by us earlier, ACR’s of officers who have either retired or are out of service otherwise, may be substituted with eligible, suitable replacements & sent for consideration. The matter may please be treated with care & importance as Superintendents in Tamilnadu Zone are acutely stagnated.

2.  The issue of large scale deviations in transfers done by Chennai II Commissionerate had been taken up with your good self through letters 36 & 37/09 dated 23/6/09 & 24/6/09 respectively as also with the Commissioner of Central Excise, Chennai II earlier, vide references dated 16/6 & 19/6/2009.

The matter is also being pursued with our All India office bearers in view of the serious implications it has for transfers to be effected in future. As made known to us by the administrators of Chennai II, the tenure of certain Ranges have been fixed as one year. It is not known whether a due diligence exercise was done in accordance with the propositions contained in the instructions issued in this regard by the Director General, Vigilance. The dichotomy and the double standards are manifest by the fact that for Inspectors the tenure has been decided to be two years. The deviations are not related exclusively to Ranges alone but span every sphere of posting which fact had been highlighted by us in our letters addressed to you earlier.

3.  The issue of extension of one year given to an officer on promotion and allowing

him to retain the seniority of June 2007 DPC despite the fact that three DPC’s had

happened in the interregnum, had been taken up on multiple occasions by this

association through references 14/09 dated 25/03/09 & 31/09 dated 08/06/09 as also personally during the discussions held on 23/06/09. It is requested that this issue may please be taken up with the attention it deserves and that strictly on issues of propriety & the damage it has caused to the career prospects of the cadre the matter had been taken up and nothing more should be read into it. In addition, it is requested that the matter may be handled with the sensitivity it warrants as some references have been made to us to go slow on the issue.

As a feedback in respect of points raised against serial numbers [2] & [3] have to be given to the All India Association a reply at the earliest may please be given to the Association.

Points to be taken up on Chennai assn’s behalf

1.The implementation of ACES in places like Chennai was taken up earlier with the All India

Assn and it harmful implications were informed. As of now ACES has been implemented in

four formations LTU Chennai/ Bangalore, Service Tax, Chennai & Bhubaneshwar.It will be a

short while before it is extended to all the formations under CBEC. It is requested that

awareness may please be created among all units immediately so that the matter can be

discussed on a priority basis in the ensuing Convention. The convergence of LTU’s/ACES &

National GST are also required to be discussed.

2.5400 Grade Pay effective 1/1/06 has been agitating the minds of the cadre and on a priority

basis the issue of clarification on the lines issued by CBDT may be obtained

from the CBEC.

3.DPC’s for the post of Asst. Commissioners are not being held with the same regularity as is

being done in the case of other cadres. The recent order relating to DC’s has not been given

with retrospective effect. By necessary implication it is only a promotion and not a STS

upgradation. If so steps may be initiated to get the AC’s post filled up.

4.Intervention of the All India Assn is required regularly in matters pertaining to units as many

of the problems remain unresolved at the Zonal level and the units are unable to take it up to a

higher level.

Sub : Shifting of Tambaram Division – Reg.

It has been brought to the notice of the Association that the present premises (No.130-B, Mudichur Road, Tambaram West, Chennai - 45) in which the Two Divisions of Tambaram are functioning is proposed to be relocated to a building at Rajakeelpakkam (a Panchayat), East Tambaram in Tambaram-Velachery Road falling outside the Municipal limits of Tambaram. The proposed place is not conveniently connected either by road or by rail and is located about 6 km away from Tambaram Railway Station, which is the nearest Railway station. The move not only inconveniences the staff, but also the Trade, some of whom have represented to the administration. During monsoon, the Office will remain cut-off, for a major section of the staff as well as the Trade and many of whom are located south of Tambaram(beyond) and between Tambaram & Chengalpattu. The proposed place will involve an additional trek or transportation of 6 km. The reason being advanced for the proposed shift is the widening of Mudichur Road, which in our view is not a major factor as the other occupants like the Income Tax Department, Indian Overseas bank propose to continue in that building for the dislocation is considered insignificant and the addition of space is possible at the rear side of the building which we are informed the owner is willing to accommodate. Economy also militates against such a move as the rent per sq.ft in the present premises is Rs.9.55/- whereas in the proposed premises, it is Rs.25/- per sq.ft. You will appreciate that neither economic nor geographical reasons make a sound contribution to the proposed move of shifting the Divisions from the present premises. This Association requests you to immediately halt the proposed shift and allow the Divisions to function from the present premises till such time a convenient premises well connected both by Road & Rail in West or East Tambaram is identified.

2. The ratio of 6 : 1 : 2 for promotions to the grade of Assistant Commissioners from among Superintendents (Excise), Superintendents (Customs), Appraisers, when applied (year) & the basis of such application, i.e., whether vacancy based or post based.

3. For years preceding the application of ratio 6 : 1 : 2, the then prevalent ratio & reasons for adoption of such ratio.

4. The qualifying service prescribed for promotion to the feeder cadres, namely – Superintendents (Excise), Superintendents (Customs) & Appraisers, from the grades of Inspector, Preventive Officer & Examiner respectively and the reasons for adoption of different norms in prescription of qualifying service.

5. In the latest round of promotions ordered to the grade of Assistant Commissioners the year of joining of the last person in the grades of Superintendent (Excise), Superintendent (Customs) & Appraiser in the base cadre of Inspector, Preventive officer & Examiner. In other words, the date of joining of the last person in the grades of Inspector, Preventive officer & Examiner, who have become Assistant Commissioners.

6. The basis for fixing seniority for promotion to the grade of Assistant Commissioners from among Superintendent (Excise), Superintendent (Customs), Appraiser & Technocrat and how it is fixed, with appropriate illustrations.

7. Please state whether it is true that the Department is yet to finalise the seniority list of feeder cadres for promotion to the grade of Assistant Commissioner for the last 30 years. If otherwise, a copy of the finalized seniority list may please be furnished. In case the reply is in the affirmative, the reasons for not finalizing the seniority list may be given.

8. Whether it is true that the promotions to the grade of Assistant Commissioners from Appraisers between the years 1992 & 1996 were on an Ad-hoc basis. If so, the date or the period during which the ad-hoc promotions ordered in respect of Appraisers between the years 1992 to 1996 were regularized.

In other words, the date or the period during which DPC was convened to regularise the Appraisers promoted to grade of Assistant Commissioner on ad-hoc basis between the years 1992 to 1996.
