The Bay Area’s Comic Book Hero Rules

  1. How to Enter the Contest:

A. The Bay Area’s Comic Book Hero Rules will begin September 15th at 9am and end October 26th at noon.

B. To participate in the contest, you must complete a brief on-line application, available at www.cwbayarea.com, and upload sketches, story boards, or animations of your original comic book character. You may also upload an optional videotaped audition of not less than one minute and not more than three minutes in length.

Only the following file extension formats can be accepted: .3g2, .3gp, .aac, .aif, .aiff, .asf, .avi, .bmp, .divx, .dv, .flv, .gif, .jpeg, .jpg, .m1v, .m4a, .mov, .mp3, .mp4, .mpeg, .mpg, .mpv, .png, .qt, .tif, .wav, .wma, .wmv, .xvid. File size cannot exceed 20MB.

By entering, you understand your photographs and/or video will be posted online and will be subject to viewing and voting by members of the general public. Posting will not be immediate; there may be a short period of time between video submission and posting. Any entry deemed inappropriate or unsuitable for posting, in Sponsor's sole discretion, will be disqualified and will not appear on the contest website.

C. Contest sponsors are not responsible for late, lost, stolen, misdirected, incomplete, misaddressed, postage due or illegible entries. Sponsor is not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, inability to access any Web site or on-line service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If the judges determine, in their sole discretion, that there is any suspected or actual electronic tampering with the Contest or if technical difficulties compromise the integrity of the Contest, the judges reserve the right to void the entries at issue and/or terminate the Contest and conduct a random drawing to award the prize among all eligible entries received as of the termination date. If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.cwbayarea.com. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to disqualify any entrant that tampers with the operation of the Contest or website or violates the Official Rules of the Contest.

D. By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: www.cwbayarea.com/privacy.

E. Odds of winning depend on number of eligible entries received.

F. Entry deemed made by holder of e-mail account.

2.  Eligibility Requirements:

A. You must be at least twelve years old (must have parental consent under 18) to enter.

B. You must be a citizen of the United States and a resident of the San Francisco DMA at the time of submission. Employees of CBS 5, CW Bay Area, CBS Corporation, Academy of Art University, Craft Animations, Aquent, other television and radio stations in the San Francisco market, and their affiliates, subsidiaries and advertising agencies and their immediate family members or persons living in the same household are ineligible to participate or win.

D. If you are selected as the Grand Prize winner, you must agree to make yourself available for a three day shoot to be scheduled by KBCW within 24 hours of the date you are notified of your prize.

E. Viewers are eligible to win a KBCW contest only once every sixty days. Only one winner per household is permitted in any contest. Viewers are eligible to win a prize valued at $600.00 or more only once every six months.

F. All entries become the sole property of Station and will not be returned. By entering, entrants agree to abide by these rules, and warrant and represent that their entry is their original work.

3.  Prizes

A. One (1) grand prize winner will receive an Adobe Creative Suite 3, a Wacom tablet, the opportunity to have your illustration featured in the San Francisco Chronicle, and you will be featured in a promo spot created by KBCW. Estimated cash value of this prize is $1300.

B. THE WINNER WILL BE REQUIRED TO CONTACT KBCW TO CLAIM THEIR PRIZE, AND SIGN AND RETURN AN AFFIDAVIT OF ELIGIBILITY AND RELEASE OF LIABILIITY, WITHIN TWENTY-FOUR HOURS OF NOTIFICATION OR HE/SHE WILL FORFEIT THE PRIZE AND AN ALTERNATE WINNER WILL BE SELECTED.

C. WINNERS ARE RESPONSIBLE FOR ALL FEDERAL, STATE AND LOCAL TAXES, AND EACH PRIZEWINNER WILL BE REQUIRED TO COMPLETE AN IRS FORM W-9.

D. All prizes or prize certificates may be picked up at the office of KBCW, 855 Battery St., San Francisco, CA 94111. You must contact KBCW within 48 hours of being notified of winning, or the prize will be forfeited.

E. Contest prizes are not transferable. Prizes may not be substituted for or redeemed for cash. Station reserves the right to substitute prize of comparable value.

4.  Selection of Winner:

A. Decisions of contest sponsors with respect to the contest are final.

B. Judging will occur in two stages.

Phase I: Determining Finalists:

On October 10th, a panel of judges from KBCW-TV will score each applicant on a scale of 1 to 100 points based upon the material they have uploaded and their responses to the online questionnaire. The twenty (20) entries with the most points will become finalists and all other entries will be eliminated from competition.

Phase II: Determining the Grand Prize Winner:

Beginning October 14th, at 12:00pm, and concluding at 12:00pm on October 26th 2008, members of the public will be able to vote for their favorite “comic book hero” at www.cwbayarea.com. Following conclusion of online voting, the 20 finalists will be assigned a score between 1 and 40 derived by the following two factors:

Judges Evaluation (30 potential points)

A second panel of judges from KBCW-TV will score each applicant on a scale of 1 to 30 points based on the contents of their portfolio and their responses to the online questionnaire.

Internet Vote Ranking (10 potential points)

Based upon the applicant’s ranking after online votes from the public at www.cwbayarea.com have been tallied. The applicant(s) who receives the most votes will receive 10 points. Videos in the 90-99 percentile will receive 9 points; 80-89percentile, 8 points; 70-79 percentile, 7 points; 60-69 percentile, 6 points; 50-59 percentile, 5 points; 40-49 percentile, 4 points; 30-39 percentile, 3 points; 20-29 percentile, 2 points; 11-19 percentile, 1 point; and 1-9th percentile, 0 points.

The entry with the most total points will be deemed the Grand Prize Winner. In the event more than one video ties for 1st place, the Grand Prize winner will be determined by a second review and vote by the panel of judges. The grand prize winner will be notified by KBCW by telephone or e-mail on or about 10/29/08 and will be revealed to the public on or about 11/7/08

5.  Conditions:

A. Payment of all federal, state and local taxes is the sole responsibility of the winner and winners may receive an IRS Form 1099 or equivalent from Station.

B. By participating in the contest, the winner agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, and to sign a publicity release, affidavit of eligibility and release of liability prior to acceptance of the prize. By accepting the prize, winner grants to Station the right to use the winner's name, voice, picture and/or likeness for purposes of advertising and publicity in any and all media now known or hereafter invented, without further permission or additional compensation (except where prohibited by law). All expenses on receipt and use of prize are the sole responsibility of winner. Winner, by acceptance of their prizes, agrees to release KBCW, CBS Corporation, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any prize-related activity.

C. Contest sponsors reserve the right to make changes in the rules of the contest which will become effective upon announcement.

D. Sponsor is not responsible for any typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of the prize.

E. No purchase necessary. The contest is void where prohibited by law.

F. Failure to comply with the contest rules may result in a contestant’s disqualification.
