Terms and Conditions (Terms)

1 Eligibility

§ The Samsung Paralympic Bloggers Competition (Competition) is only open to athletes who have qualified, or are aspiring to qualify, for the PyeongChang 2018 Paralympic Winter Games (PyeongChang 2018) (Participants). All Participants must be aged over 18.

§ The six (6) winners of the Competition will be invited to join the PyeongChang 2018 team of Samsung Paralympic Bloggers, who will record behind-the-scenes videos of the life of an athlete in the lead-up to and during PyeongChang 2018.

§ Videos must be submitted by posting the video on a public social media account (Facebook, Twitter or Instagram) with the hashtags #ProudParalympian and #PyeongChang2018 included in the post. Video submissions posted on Facebook must be posted to the Proud Paralympian’s timeline (Facebook.com/ProudParalympian) for them to be entered into the Competition. Video submissions posted on Twitter and Instagram can be posted on participant’s own timeline, provided it is a public account.

§ Participants must follow the Proud Paralympian account on the platform they use to submit their entry, e.g. @ProudPara on Twitter and @ProudParalympian on Facebook and Instagram, to enable the IPC to contact them via direct message / Messenger.

2 Video Format

§ Smartphone, tablet or video recorder may be used to record the video.

§ High-resolution quality is recommended.

§ Videos are encouraged to be submitted in English although other languages are eligible for entry.

§ Videos must not exceed 60 seconds in length, unless otherwise determined by the IPC.

§ Videos must be in a blogger format.

3 Content

§ Videos must be submitted by an individual Participant not a team.

§ Videos must provide a visually compelling and clear story.

§ Videos may have one of the following focus areas from Participants: sports focus (how they exceed expectations in their field); day to day life (how they break down barriers daily); or active citizen focus (how they break down barriers in the community).

§ Videos must be new or adapted to align with these Terms.

§ Videos must only include appropriate language and content in alignment with the objectives of the Competition.

§ Videos must not violate any IPC rules, regulations or policies and must not violate any laws.

4 Agreement

§ By entering the Competition, Participants accept these Terms.

§ By submitting a video, each Participant acknowledges that they may be contacted directly by the IPC for further information regarding the Competition (including, but not limited to, a request for their name, a photograph, their sport and country).

§ By submitting a video, each Participant grants the IPC the right to use their name, photograph (as provided to the IPC), sport and country for the purpose of identifying them as the author of their video and/or as a shortlisted candidate and/or a winner of the Competition.

§ In consideration for the right to enter the Competition, each Participant agrees that their video, together with their name, photograph (as provided to the IPC), sport and country (Entry), may be used in any content, format and through any media or technology whether now existing or created in the future, by the IPC, Samsung and other third parties authorised by the IPC throughout the world in perpetuity and without compensation (financial or otherwise), for any purpose in a commercial and non-commercial manner.

§ Each Participant assigns all rights in their Entry to the IPC and irrecoverably waives the right to assert any moral (or similar) rights in their Entry under any law.

§ Participants waive the right to inspect, or approve their Entry and understand that the IPC (and third parties authorised by the IPC) shall have the right to edit, copy, adapt or translate the videos in the IPC’s sole discretion. Participants understand that the IPC is under no obligation to use their video for any purpose.

§ Each Participant represents and warrants that: (i) they have the legal capacity to enter into the Competition; (ii) they are able to make and assign their Entry; (iii) to the best of their knowledge and belief their Entry is truthful, does not incorporate or include anything that is owned by a third party (or would require the consent of any third party), and does not infringe any law or the copyright, trademark or any other right of any third party; and (iv) their Entry will not be obscene, will not depict violent, racist, sexist or any other discriminatory behaviour.

§ Each Participant confirms that any personal information provided to the IPC (including their name, a photograph, sport and country, together “Personal Data”) is true, complete and accurate. Each Participant acknowledges that their Personal Data is being collected by the IPC and such Personal Data is being stored and used by the IPC (including being transferred to or stored on the IPC’s owned or contracted servers) and transferred to IPC partners for the purposes of, and to the extent necessary in relation to, facilitating participation in the Competition. Each Participant acknowledges that, under data protection law, they have a right to access their Personal Data and/or ask any questions about these Terms by contacting the IPC at: .

§ Each Participant acknowledges that they participate in the Competition at their own risk. Each Participant releases the IPC (and its officers, directors, members, employees, agents, representatives, contractors, staff and partners (hereafter the “Third Parties”)) from any and all claims or causes of action they may have for damages for personal or bodily injury, disability, death, loss or damage to person or property relating in any way to the use of their Entry, whether arising through negligence of any or all of the IPC, Third Parties or otherwise, to the fullest extent permitted by law.

§ Each Participant agrees to defend, indemnify and hold harmless the IPC and Third Parties on demand, against any loses, expenses or damages suffered by the IPC or Third Parties resulting from the use (as permitted by these Terms) of their Entry, or their breach of any of representations or warranties contained in these Terms.

5 Submissions

§ Participants are responsible for the cost (if any) of creating their Entry and submitting it.

§ Videos must not feature any branded product or equipment other than Samsung.

§ Only one entry is permitted per Participant.

§ The IPC may disqualify an entry that does not comply with these Terms if a Participant cannot be contacted or does not respond within ten (10) days of being contacted by the IPC. In the event of disqualification, the IPC may, in its sole discretion, select a new shortlisted or finalised entry.

§ Entries on behalf of another person will not be accepted and joint entries are not permitted.

§ Entries must be made by a Participant.

6 Selection Criteria

§ All entries are subject to the approval of each Participant’s respective National Paralympic Committee (NPC).

§ All entries are subject to the approval of Samsung.

§ A panel of judges (including a representative from Samsung and from the IPC Athletes Council) will shortlist the videos, based on the following criteria: the technical quality of the video; how closely the content aligns with breaking down barriers and Proud Paralympian; and how engaging the video content is.

§ By submitting an entry each Participant acknowledges that their video may not be shortlisted and they may not be contacted by the IPC for further information.

7 Voting

§ The IPC reserves the right to announce shortlisted and final entries as it sees fit, including through publication via press release and/or on social media.

§ The public will be provided a pre-set voting period to vote for their favourite shortlisted videos on a dedicated landing page on Paralympic.org. By entering video submissions, Participants acknowledge that their videos may be shortlisted and may be subject to public voting on Paralympic.org.

§ The Participants who submitted the six (6) videos that receive the most votes will be invited by the IPC to become a Samsung Paralympic Blogger at PyeongChang 2018 (Blogger). In the event that any invitation is declined, the IPC may invite the Participant(s) whose video(s) received the next greatest number of votes.

8 Benefits

§ Shortlisted and winning Entries will be featured across various IPC media platforms.

§ Shortlisted and winning Entries will be featured across IPC partner channels.

§ All invited Participants that accept the invitation to be a Blogger will receive a special goodie pack from Samsung and will join the team of Samsung Paralympic Bloggers for PyeongChang 2018.

§ The best Blogger at PyeongChang 2018 (as determined by the IPC in its sole discretion) will receive a special gift, as determined by the IPC in its sole discretion. There will be a photo opportunity and press release.

§ The IPC has the right to remove or change at any time, in its sole discretion, for any reason the benefits outlined in these Terms.

9 Deadline

§ All entries must be submitted by 10 December 2017, 11:59pm (CET). Entries received after this date and time will not be considered.

§ Shortlisted candidates will be notified after 15 December 2017.

10 Other rules

§ The IPC takes no responsibility for entries that are lost, delayed, misdirected, or incomplete or that cannot be delivered or entered for any technical or other reason.

§ Each video must feature the Participant (and if other persons are featured such persons must be aged 16 and over and must have provided the Participant with their express permission to be featured).

§ Each Entry must be the own work of each Participant, must not be copied, must not contain any third-party materials and/or content (including background music) that the Participant does not have permission to use and must not include inappropriate or dangerous behavior. If the IPC has any reason to believe an Entry is not the own work of a Participant, if any person objects to the inclusion of a video in which they are featured being included in the Competition, or if an Entry otherwise breaches these Terms then the IPC may disqualify it.

§ The IPC reserves the right at any time and from time to time to modify or discontinue the Competition, temporarily or permanently without notice.

§ The decision of the IPC in all matters under its control is final and binding.

§ The IPC reserves the right to disqualify Entries at any time in its absolute discretion.

§ The IPC reserves the right to discount votes if they suspect fraudulent bulk voting or multiple voting is or has taken place to inappropriately influence or manipulate the voting procedures.

§ The IPC accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by any Participant as a result of entering the Competition or accepting any prize.

§ This Agreement is governed by the laws of Germany and the jurisdiction of the German courts applies.
