RESOLUTION OF TOWNSHIP TRUSTEES
AGREEING TO COOPERATE WITH THE OHIO DEPARTMENT OF TRANSPORTATION
Mr./Ms. moved the adoption of the following resolution:
BE IT RESOLVED, by the Board of Trustees of Goshen Township, Ohio, that
WHEREAS, the public interest demands the hereinafter described, therefore,
BE IT RESOLVED, that the public interest demands the construction of a sidewalk within the right of way on part of State Route 534 situated in the Township of Goshen, County of Mahoning, State of Ohio, and as described as the PROJECT follows: installation of approximately 2,550 lin. Ft. of pedestrian sidewalk within the right of way of SR 534 from US 62 north to West Branch Jr. High School.
BE IT FURTHER RESOLVED, that the Board of Township Trustees of Goshen Township, County of Mahoning, Ohio under the provisions of the Ohio Revised Code does hereby agree to cooperate with the Ohio Department of Transportation, hereinafter referred to as the STATE, in said improvement in the following ways and extent:
It is recognized by the Ohio Department of Transportation that units of government embrace the policy of providing public sidewalks along some thoroughfares in their domain. It is further recognized as the
policy of the Ohio Department of Transportation not to construct sidewalks in its right of way except when the unit of government involved will release the State and its authorized agents from any
damages or claims of damages from this project and will accept and assume the responsibility for the maintenance, removal of snow and ice, repair and replacement of said sidewalks at such time as either is required; then the OhioDepartment of Transportation will permit the Township Trustees to install said sidewalk.
THEREFORE: in return for the permission of the Ohio Department of Transportation to construct said sidewalk, the Board of Trustees of Goshen Township, county of Mahoning, agree to release and indemnify the Ohio Department of Transportation and its employees and agents from any damages and claims arising out of the construction and use of this sidewalk. Furthermore, the Board of Trustees accept and assume the responsibility for the maintenance, removal of snow and ice, repair and replacement of said sidewalk at such time as either is required.
