NARRATIVE: On 7/29/11, Detective Ramos of the Boynton Beach Police Department interviewed
Confidential Witness 1 at the Palm Beach State Attorney's Office in reference to SA Case
#12000797. During the interview Confidential Witness 1 advised the following: Approximately four
weeks prior to the interview he responded to a Craigslist personal ad in which the person was seeking an adult male to engage in sexual activity with his wife in their home. Confidential Witness 1 replied to the ad and began communicating with a male subject known only as "Stew." Stew explained in an email communication that his "girlfriend" liked to have sex while "asleep." Confidential Witness 1 stated he took "asleep" to mean the female would be roleplaying and would really be awake. In arriving to the residence, Confidential Witness 1 was met by "Stew" and led into the residence. Stew then asked Confidential Witness 1 if he wanted to see some pornography and proceeded to show Confidential Witness 1 pornography on a laptop computer set up in the dining area. Confidential Witness 1 believed the pornography was taken by Stew, as the images appeared to have been taken in the same apartment. Confidential Witness 1 described seeing a folder entitled "C" containing images of two minor females whom Stew advised were his step daughter and her friend. Stew further told Confidential Witness 1 that he had a hidden camera disguised as an air freshener in the bathroom, and that he took videos of his girlfriend's daughter while she was nude in the bathroom. Confidential Witness 1 advised both females appeared to be asleep in the pictures and that Stew had told him he would put medicine in their ice cream and waited until they fell asleep before taking photos of them. Confidential Witness 1 described pictures of a minor female lying on a bed with her shirt pulled up, exposing her breast. Another picture was of a male's hand holding her vagina open, and another was a close up of the minor's nipple. After viewing the pornography, Confidential Witness 1 was taken to a bedroom and engaged in sexual activity with an adult female who he assumed was Stew's girlfriend. Confidential Witness 1 stated he did not communicate with the female prior to or during the encounter as she appeared to be asleep, and that Stew stood and watched while he engaged in sexual activity with her. Confidential Witness 1 advised he did not use
a condom while having vaginal intercourse with the female and ejaculated inside her. Confidential
Witness 1 described the female as having dark hair, a skinny build and possibly in her forties.
On 3/13/12, Investigator Glenn Wescott of the Office of the State Attorney continued the investigation of SA Case#SA12000797. In interviewing Confidential Witness 2 regarding the investigation, he advised the following: On an unknown date and time in November 2011, December 2011 and the end of January 2012, Confidential Witness 2 had sexual intercourse with a white adult female (Ronit Pryor) while she was in a state of unconsciousness, after responding to a Craigslist ad in which the person placing the ad was seeking a male to "massage" his wife. The male identified himself as "Stew" (Stuart Michael Miller - DOB
3/29/51), and through email exchanges, arrangements were made for Confidential Witness 2 to engage in sexually activity with Miller's wife in their home, while she was unconscious.
Miller had advised Confidential Witness 2 that Pryor enjoyed having sex while unconscious.
Upon arrival to the residence Confidential Witness 2 was greeted by Miller and led into a bedroom within the residence. Upon entering the bedroom Confidential Witness 2 saw Pryor lying on a bed, dressed in a black negligee. Pryor appeared to be unconscious, and did not acknowledge or respond prior to or during the sexual encounter. Confidential Witness 2 performed oral sex on Pryor and vaginally penetrated her. Upon ejaculating into a condom, he flushed the condom in the toilet and left the residence. During the encounter Stuart Miller had instructed Confidential Witness 2 on what to do, then watched while Confidential Witness 2 engaged in sexual activity with Pryor. Confidential Witness 2 had a sexual encounter with Pryor on 3 separate occasions, each time while Pryor appeared to be unconscious and non responsive and dressed in the same black negligee. After the third sexual encounter, Miller told Confidential Witness 2 he wanted him to engage in the same type sexual encounter with his step daughter and wife together. When Confidential Witness 2 declined the offer, Miller became irate. Confidential Witness 2 advised he was unaware if Miller had taped any of the sexual encounters with his wife. On 1/18/12, after Confidential Witness 2 declined the offer, Miller sent him an email and attached 17 pictures of his step daughter {victim.} Of the 17 pictures attached, ten (10) appear to have been taken from a hidden camera in a bathroom within the home and are of victim, in the nude. Seven (7} pictures attached are of victim lying on a bed, sleeping or in an unconscious state, partially disrobed with her breasts and vagina exposed. In one (1) picture an unidentified male's penis appears to be in union with the victim's anus. Included in the email sent from Miller to Confidential Witness 2 was a message from Miller which stated the following:" Here are some pies. The last one is a friend of mine rubbing his cock on her ass. He shot a load on her tits after that (on one of the pies you can see the shine of it and it's also on the arm sleeve of her pj's). Text me what you think?"
On 3/22/12, the case was turned over to this detective by the State Attorney's Office for further investigation.
On 3/25/12, a search warrant was executed at the home of Stewart Miller and Ronit Pryor.
In a sworn taped statement Ronit Pryor advised she resides in the home with Stewart Miller and participates in a sexual relationship in which Miller locates men through the internet and invites them into the home to have sex with her. Ronit advised the encounters are consensual and that she enjoys being blindfolded, or keeps her eyes closed so that she does not see the men. Ronit states that occasionally she falls asleep or is unconscious during the sexual encounter, but that Miller ensures the men wear condoms so that she does not get an STD.
In informing Ronit that 2 males have come forward alleging a sexual encounter with her while she was unconscious, and that one male ejaculated inside of her without the use of a condom, she became distraught and began to cry. When shown pictures of the victim taken in the bathroom and of those of victim in bed, in which she also appears to be sleeping or unconscious, Ronit identified the locations as being within the home. When questioned as to if she had knowledge of victim being medicated and having sex with men brought in by Miller, she stated no. Ronit advised the victim is a mentally challenged adult female who resides outside of the home but often comes for an overnight stay.
Post Miranda Stewart Miller advised he has an open relationship with Ronit Pryor, in which she consents to engaging in sexual activity with men while pretending to be asleep, or in an unconscious state. When confronted, Miller admitted to sending pictures of the victim to a person he met through Craigslist and that the victim was aware the pictures were being taken and that she posed as "sleeping" in the photographs taken of her in bed as part of the "fantasy." Miller advised he is the person in the picture which showed a penis which appears to be in union with the victim's anus and that the sexual encounter was consensual. Miller advised he has had 2 sexual encounters with victim in the past year. When asked, Miller refused to advise who had taken the pictures of the victim in the shower, but did admit to having owned a surveillance camera. When questioned about medication, Miller first advised he only took a prescribed medication for acid reflux and Viagra. When then questioned as to a bottle of prescribed medication found in the freezer directly behind a quart of ice cream, Miller stated he "sometimes" used the medication to help him sleep. He denied using the medication to mix in with ice cream to sedate minors, stating he was "bullshitting" when telling others he did that.
On 3/26/12, contact was made with the victim, a mentally disabled 32 year old female who resides in an independent living facility, but often spends weekend with her mother at Miller's home. In determining the victim was able to understand and answer questions asked of her and able to determine a truth from a lie, she consented to an interview and advised the following: In reference to the pictures taken of her in a bathroom, she identified the location as being at Miller's residence. She has no knowledge of the pictures being taken of her, or of who had taken them. In regards to the pictures taken of her in bed, with her breasts and vagina exposed while she appears asleep or unconscious, she again advised she has no recollection or knowledge of the pictures being taken, or who had taken them. When the victim was advised Miller had stated that she had consented to his taking the pictures and had "posed" to be sleeping, she adamantly denied such and became highly upset. The victim further denied being involved with Miller sexually at any time, denied having an "affair" with him and denied to consenting to his taking the pictures. In showing the victim the photograph of a penis in contact/in union with her anus, she advised she had no knowledge or recollection of the sexual act and did not consent to participate in any way. When asked if Miller had ever given her ice cream to eat prior to going to sleep at night, she stated no, but that he frequently gives her Nyquil to help her sleep when she sleeps over. The victim advised she has used Nyquil in the past to help her sleep when in her own home and that Miller had given Nyquil that appeared to be much stronger.
Based on my investigation, I am requesting a warrant be issued for the arrest of Stewart Miller for
2 counts of the Sexual Battery on a Mentally Defective Person, contrary to F.S.S. 794.011 (4E).
