On-The-Job Training (OJT), Customized Training Agreement Checklist 2011-2012
On / ON-THE-JOB/CUSTOMIZED TRAINING CONTRACT PROVISIONS / COMMENTSDoes the OJT contract provide the following specified contract provisions:
No training will commence prior to the contracted training start date.
The training position and duration of training occupation(s) is limited to time required for the trainee to become proficient in the training occupation.
The wage rate is the same as wages paid to employees who are similarly situated in similar occupations (applies to OJT participants only).
A detailed description of the training position skills to be mastered and, if applicable, the type of credential to be awarded.
Safety and health standards applicable to the workplace.
Workers’ Compensation coverage.
The employer will maintain attendance and payroll records for all trainees.
The rate and criteria for payment/reimbursement of training cost (up to 50% of wages or higher if waiver in effect for OJT, at least 50% contribution from employer or higher if waiver in effect for customized training).
The expectation that the employer will retain trainee in unsubsidized employment after completion of training.
The WIA record retention period.
The employer will provide RWB, State, and Federal staff access to all records associates with the training agreement.
The contract modification and termination, and dispute resolution.
OJT/CUSTOMIZED TRAINING CONTRACT PROHIBITIOINS
Does the OJT/Customized Training agreement address the prohibition of:
Development of OJT or Customized Training positions that will or may displace, reduce the hours of, or infringe on the promotional opportunities of current employees.
Development of OJT positions if another individual is on layoff from the same or a substantially equivalent job (only applies to OJT participants).
Development of OJT or Customized Training positions with employer who relocated all or part of its business (located in the USA or its territories) within the previous 120 days and relocation resulted in the loss of employment at original site.
Development of OJT or Customized Training positions without union concurrence, if workers are unionized.
Discrimination on the basis of race, color, religion, sex, national origin, age, political affiliation, and disability.
Training of participants in sectarian activities.
Placement in employment to carry out the construction, maintenance, or operation of any part of a facility that is used for sectarian purposes.
