ROLL CALL

Ms. Dunn called the meeting to order at 12:20 p.m.

ACTING CHAIRPERSON

In the absence of Chairman Tedford, it was necessary for the Board to appoint an Acting Chairperson for the meeting. Mr. Valentino was nominated by Mr. Andrus and seconded by Ms. Solmonson to serve in this capacity. The Board unanimously voted to appoint Mr. Valentino as Acting Chairperson.

APPLICATIONS FOR NEW BEER PERMIT

for Earth Day Event (April 25, 2009)

Class “E” Permit

Ms. Billman and Roger Harb were not present for the beer permit and there was not sufficient time to re-schedule a meeting for this permit should the applicant so request. Neither Ms. Billman or Mr. Harb notified the Legal Department of any intention to not appear. Ms. Dunn did state that Mr. Stan Duncan had emailed the City’s Risk Manager to state that Earth Day no longer wished to pursue a beer permit for this event. Mr. Andrus moved, seconded by Mr. Valentino, to deny the beer permit application and the motion carried unanimously.

The beer permit for this application was denied, so there was no need to vote on a manager approval for the special event beer permit.

Mr. Garbett was present to discuss his manager application. Upon the basis of his application, Mr. Bailey moved, seconded by Ms. Solmonson, to approve the application and the motion carried unanimously.

Jose Hernaldo Guzman

El Arriero Mexican Restaurant, Inc.

1140 Oak Ridge Turnpike

Mr. Guzman was not present for the meeting. Ms. Dunn reported that a female employee of El Arriero’s came by the Legal Department today to fill out a manager application and the employee stated that Mr. Guzman was no longer pursuing a manager application for this establishment. Ms. Dunn also reported that she told this employee the owners of the establishment were to appear at today’s meeting. The Board will re-schedule the conversation with the owners of El Arriero to the next regular meeting.

OLD/NEW BUSINESS

Warehouse Tavern

Ms. Dunn reported that Mr. Phillips, owner of the Warehouse Tavern, had still not paid the privilege tax payment. Ms. Dunn also reported that Mr. Phillips was aware of his required attendance at today’s meeting because he received the letter on behalf of the Board was that sent via the Police Department.

Mr. Bailey moved, seconded by Mr. Andrus, to require the owner of the Warehouse Tavern to appear for a show cause hearing on May 11, 2009 at 12:30 p.m. (after the next regular meeting) and the motion carried unanimously.

Brewski’s

Ms. Dunn reported on recent activity at Brewski’s due to a citizen concern after reading in The Oak Ridger that the Police Department had been to the establishment 26 times in the past year. While this number is accurate, it is misleading in that it includes ten walk-throughs of the establishment which are routine and not a result of any complaint. The Board was concerned over four instances that occurred since January 2009 where reports were made from the hospital about disturbances/assaults at the premises. Mr. Bailey moved, seconded by Mr. Valentino, to request the presence of the owners at the next regular meeting for a discussion about these instances. This is not a call for a show cause hearing at this time.

Having no more business to come before the Board, the meeting was adjourned at 12:40 p.m.
