A new law now qualifies the National Guard and Ready Reserve members for motor vehicle personal property tax exemption. The 2004 Kansas Legislature amended Kansas Statute 79-5107(e), changing the eligibility criteria for military personnel qualifying for personal property tax exemption of their motor vehicles. Dependent upon the circumstances of current duty status and assignment, National Guard and Reserve personnel may now qualify for motor vehicle personal property tax exemption. “This is really good news for Kansas National Guard and Reserve soldiers that have been called away from home,” said Carmen Alldritt, Director of Vehicles. “This is one small way we can be of help to Kansans who have been sent to serve our country. If they have to be away from home, at least it will be a little easier on their pocketbooks to register their vehicles,” Alldritt added. The new law requires the following to be eligible for the exemption:

1. The owner must be a Kansas resident.

2. The owner must be in the full-time regular military service of the United States, including a member of a reserve component or National Guard who has been mobilized (ordered to active duty).

3. The owner must be deployed on the date of application for motor vehicle registration. For purposes of this exemption, deployed means a serviceperson who is performing service pursuant to orders, at a location preventing or making it unfeasible for them to return to their housing normally occupied during off-duty time while on assignment at their permanent duty station or homeport. The location may be in state, or out of state.

4. The owner may receive the exemption for no more than two vehicles.

If you qualified for the exemption, military personnel will need to fill out a “Kansas Resident Military Personnel Affidavit For Motor Vehicle Tax Exemption” form PV-PP-57 and submit it to their county treasurer or appraiser’s office. The form is available on the Kansas Department of Revenue’s web site at www.ksrevenue.org. Some counties may require additional documents, including:

· The military person’s ID card: to verify full-time status & ETS date

· Leave and Earning Statement (LES): to verify permanent resident state with the military

· A copy of the military person’s orders: to verify they are mobilized and deployed outside their regular duty station at the time of registration application.

· Title to the personal property: to verify the military person is the legal owner of the property.
