STEPS IN INVESTIGATING CHARGES OF SEXUAL HARASSMENT
Step I. Act Immediately and Appropriately:
Call the Student Support office and/or your Area Assistant Superintendent to report the complaint.
Step II. Gather the Facts:
Interview the charging party.
Document what you are told (make notes).
Remind the charging party of the Sexual Harassment Rule (Rule JICK).
Ask them to complete Sexual Harassment Complaint Form (Form JICK-1). If they do not want to
complete the form, do not force the issue but complete the form yourself to document your
involvement. State that the charging party chose not to complete the form. Retain the form in the student’s discipline file.
In interviewing the charging party, ask the following questions:
What did he/she do? (Get specifics)
What did he/she say? (Get specifics)
When did this happen? (Get specifics)
Where did this happen? (Get specifics)
Were there any witnesses? (If so, who?)
Has this happened before? (Get specifics)
Has this happened to others? (If so, who?)
Avoid being judgmental. Remain objective; you have only heard one side of the story.
Step III. Interview All Identified Witnesses:
Ask the same questions you asked the charging party.
Step IV. Interview the Charged Party:
Make him/her aware of the complaint. (Not the name of the charging party)
Ask if they have done what was alleged.
Ask if they have any witnesses.
Avoid being judgmental. Remain objective.
Step V. Finding of Fact:
After completion of the investigation, prepare a written report of finding of fact. Include evidence in support of the findings and a statement of action taken and/or recommendations to the Student
Support office. Retain this written report in the student’s discipline file.
Step VI. Advice Against Retaliation:
If the sexual harassment is confirmed, the administration must contact the parents of the
perpetrator. Advise the harasser that any form of retaliation will not be tolerated.
Notify parents of victim by phone and/or conference to inform them of the disposition of the case
without revealing names. Write a letter providing parents the information that a complaint was
received, that a full investigation took place and what the findings were in the case.

without that person’s consent.
