1 3 . 175 Public Speaking Time

Mr J Harding spoke about the land at Halse Hill/West Hill Lane. He said that he was saddened at how little Budleigh Salterton can rely upon Tree Preservation Orders and retaining the green wedge. He believed that other areas and trees must also be at risk in East Devon. He had the impression of complacency from East Devon District Council as trees had to be damaged or removed before any action was taken. He had written to the Chief Executive and Monitoring Officer at EDDC regarding this matter and made a suggestion for a central database for trees with preservation orders. He invited the Town Council to support his suggestions so there could be a “neighbourhood watch” for trees.

Mr J Skillern spoke on behalf of Mr and Mrs Champernowne of 27 Victoria Place and as a resident of Redhills about application 13/1916/FUL. He said that they did not support the application and he felt that it was inaccurate and misleading to state in the planning application that the neighbours were supportive. The previous application was refused for two reasons and the new application changed very little. They had the same objections and it does not preserve or enhance the Conservation Area. He felt that it is a prime example of garden grabbing. There are access problems, there is no parking in the road and traffic is at saturation point. If the application was approved construction traffic could cause untold damage to the road and the cobb buildings along Victoria Place. He said that the application was inappropriate for Budleigh Salterton and for a Conservation Area. He hoped that the Town Council would find the application unacceptable and refuse it as before.

Miss H Tickle spoke about application 13/1916/FUL. She said that she felt the same as Mr Skillern and that East Devon District Council had gained a reputation for indifference for the AONB and the assets of the area. She stated that Victoria Place was well used by pedestrians and the impact of the development would be widespread. If the development were allowed no other site within the Conservation Area could be protected in the future.

Apologies were received from Cllr S V Hall (holiday), Cllr A N Gooding (unwell) and Cllr R S Mitchell (prior engagement).

Cllr Mrs L D Evans declared a personal interest in Min 13.180 (13/1916/FUL) – she lives in Victoria Place.

The Minutes of the Meeting of the Planning Committee held on 19 August 2013 had been circulated prior to the Meeting. It was unanimously agreed they be signed as a true record.

13 . 179 Declaration by District Councillors

It was formally noted that the participation of Cllr A J Dent and Cllr T D Wright, who are also Members of the East Devon District Council, in both the debate and subsequent vote, was on the basis that the views expressed were their preliminary views taking account of the information presently made available to the Town Council. They reserved their final views on the applications until they were in full possession of all the relevant arguments for and against.

Observations: This Council is unable to support this application for the following reasons:

1. Over-development of the site.

2. The development would fail to enhance or preserve the Conservation Area in which it is situated.

3. The development would fail to enhance or preserve the natural beauty and character of an area designated as an Area of Outstanding Natural Beauty.

There are concerns that the current sewage system cannot cope with this additional home in light of the numbers of homes already built in the town since the system was upgraded in 1995.

In addition, there are concerns regarding the access onto the junction with West Hill.

This proposal is contrary to Budleigh Salterton: The Future 6.94 and Strategy 21 Budleigh Salterton 6.95 in the New Local Plan.

In summary this proposal is contrary to Policies CO1, CO3 and TR10 of the Devon Structure Plan, Policies EN1, EN11, S4 and D1 of the East Devon Local Plan and guidance laid out in the Budleigh Salterton Design Statement, particularly paras 5.1.1 and 5.1.2.

Correspondence from Mr M Wright was received and considered.

The Chairman, Cllr A J Dent, thanked Mr Wright for the very thorough and comprehensive information he provided for all Councillors. He had spoken to James Brown at East Devon District Council and the points raised were entirely true and that unfortunately any work that had been undertaken during the time that a TPO was in place but not enforced cannot be undone. The Enforcement Officer and Tree Officer had found no breach. He believed the land was being prepared for a planning application but until that application was received by the Council nothing can be done.

Cllr T D Wright thanked Mr Wright for the details and said that the Council should explore the possibility of a tree database with EDDC.
