This is the Regular Meeting of the Bloomingdale Planning Board of September 12, 2013 adequate advance notice of this meeting has been provided by publication in the Herald and News and also posted on the bulletin board at the Council Chamber entrance in the Municipal Hall of the Borough of Bloomingdale, Passaic County, in compliance with the New Jersey Open Meetings Act, N.J.S.A. 10:4-6 seq.

FIRE CODE

Per State Fire Code, I, Edward Simoni, am required to acknowledge that there are two “Emergency Exits” in this Council Chamber. The main entrance through which you entered and a secondary exit to the right of where you are seated. If there is an emergency, walk orderly to the exits, exit through the door, down the stairs and out of the building. If there are any questions, please raise your hand now.

Board attorney, Anthony Sartori, reviews notice of service and states that it appears in order.

Steven and Ellen Gerber of 3 East Shore Road, Kampfe Lake, Bloomingdale, NJ are sworn in.

The following exhibits are marked:

A-1 Survey prepared by Darmstatter, Inc on 7/16/13 with revision date of 7/26/13

A-2 Dwelling Addition 1-pg Site Plan dated 7/17/13 with latest revision date of 8/2/13 prepared by Darmstatter, Inc

At this time Mr. Sartori reads letter from Kampfe Lake in to the record.

Mr. Gerber gives an overview of the application.

He states that they are taking a small house and adding a 2nd floor with the least amount of environmental impact. The addition would be above the existing 1st floor, it would be approx. 274 sq. ft. The idea is to expand without detriment or negative impact to the environment. The house is on pilings and that would be maintained.

He refers to exhibit A-2 which lists the variances they are seeking in the R-40 zone.

They are seeking a variance for:

Left side yard required: 25’ existing: 20.9 proposed: 8.0

Both side yards required: 50’ existing: 55.8’ proposed: 42.3’

Max Lt Coverage required: 15% existing: 19.7% proposed: 20.45%

The lot is currently a pre-existing non-conforming use. The garage will remain the same size and height. Existing structure needs more space and there is a positive improvement. The site plan shows no detriment to the public. Outdoor living space is screened in. The lot is one of the flattest lots with no steep slope issues.

Mr. Sartori confirms that the 2nd floor addition would include 2 bedrooms a bathroom and a closet, will the rest be unfinished.

Mr. Gerber states that the architect suggested to make it an attic, might consider converting it later. The window is purely for esthetics and will stipulate that if that room gets finished we will get all the needed permits and permission, and we would apply to the board of health for septic.

Board Engineer, Thomas Boorady, states that as matter of record, he believes we still have to deem this application complete.

Motion made by Comm. Steenstra, 2nd by Comm. Graf to deem application #653 complete. Voice vote shows all in favor.

Mr. Boorady’s 5-page report dated 8/22/13 is marked as exhibit B-1 on 9/12/13

He states that the applicant did a thorough job of summary therefore he won’t go back over those comments already addressed. He has no engineering objection.

Mr. Sartori confirms that this will in fact be a 3-bedroom pursuant to plans on record. The board will be acting on the plans submitted.

Mr. Boorady states that in doing an overview of the DEP, Kampfe Lake is connected to waterway and based on review, Mr. Gerber does qualify, no formal permit required. Just a fax sheet needs to be sent to DEP 14 days prior to construction.

He has no objections to bulk variances requested.

Mr. Gerber thanks everyone for hearing the application and hopes to be able to build.

Motion made by Comm. Graf, 2nd by Comm. Steenstra to grant bulk variances as listed. Roll call shows 7 – 0 in favor.
