Definitions

Advance Directives are a written expression of future wishes regarding medical care. There are two general types of advance directives: a Living Will and a Power of Attorney for Health Care (POAHC). An Advance Directive gives a patient a voice in decisions about their medical care, provides guidance to healthcare professionals, and most importantly provides a mechanism for individuals to maintain control over their treatment at a time when they are unable to communicate their wishes. Physicians and other health care workers are legally obligated to follow the directions patients indicate in their Advance Directive. However, the strength of an Advance Directive is greatly magnified by discussing the issues of future medical care and decisions and wishes concerning end-of-life care with family, clergy, lawyer and physicians. Both types of advance directives are approved as legal documents, published by the state and readily available at all Wisconsin health care facilities. The Wisconsin approved Living Will and POAHC forms may be completed by patients without the need of a lawyer or Notary Public.

The Living Will is a type of advance directive that documents specific instructions to health care providers about particular types of treatment an individual would want or not want to prolong life. Living wills are generally used to communicate wishes to refuse, limit or withhold life-sustaining treatment. The Wisconsin Declaration to Physicians (Living Will) allows patients to say that in the event of a “Terminal Condition” or “Persistent Vegetative State”, feeding tubes and “life-sustaining procedures” can be withheld.

The Power of Attorney for Health Care (POAHC) is another type of advance directive that enables someone to appoint another individual to make healthcare decisions for him or her should they lose decision-making capacity. The person that is appointed by the individual is called the is the "health care proxy" or "health care agent." The proxy or agent is obligated to make the kinds of decisions the individual would have made him or herself.

What is the difference between the Living Will and Health Care Power of Attorney?

The major distinction between a POAHC and a living will is that the POAHC can be used for all medical decisions not just those related to withholding or withdrawing life-sustaining treatments.

When do Advance Directives go into effect?

Advance directives only become effective when it is determined that an individual is incompetent or lacks decision-making ability. As long as an individual retains their decision-making ability, his or her decisions remain in control.

Where should Advance Directives be kept?

At least two copies of the most current should kept at home, keep one copy in the glove compartment of your car. Patients should bring one copy of their advance directive to the hospital for any elective or emergency inpatient admission. At the time of completion copies should be given to:

· the primary care and any specialist physicians

· the personal attorney

· the health care agent named in the POAHC form

· key family members not living at home

Hospice is a philosophy of care for dying patients and their families. Hospice utilizes the concept of palliative care focusing on the control of distressing physical symptoms, and psychological and spiritual support for the patient and family. The care is provided by an interdisciplinary team that recognizes that no single health care professional can meet the needs of dying patients and families. The Medicare Hospice Benefit is a reimbursement system designed to provide medical care and support for dying patients. There are specific eligibility requirements to enroll in a hospice program; traditionally these services are limited to patients with a life expectancy of less than 6 months who have chosen to no longer pursue active treatment.

Palliative Care is also philosophy of care for patients and their families facing life- limiting illness—like hospice, it also focuses on providing support and control of physical, emotional and spiritual distress. The goal of palliative care is to provide the best possible quality of life for patients and families throughout the course of an incurable disease. For some patients this approach to care includes active treatment aimed at controlling symptoms or extending life. Palliative care is an emerging medical specialty for physicians and nurses interested in improving care near the end-of-life in a variety of care settings. Palliative care is also a term applied to consultation and inpatient specialty units/programs in hospitals or nursing homes--focusing on improving care near the end-of-life. There are no limits on eligibility/service provisions and no special reimbursement
