HOMEARAMA TOURING EDITION 2017

Rules & Regulations

All participating builders/developers must be TBA members.

Read the following Rules and Regulations carefully. If you agree with and will adhere to them, and will be a Builder Member of Tidewater Builders Association (TBA) as of the date of this contract through the 2017 Homearama Touring Edition event dates, please sign below.

Note: once this contract is accepted by TBA, the contract becomes binding.

This contract is an application by the above to enter a home* in the Homearama Touring Edition 2017 (HTE) to be held Sept. 15-Sept. 17; Sept. 22-24; and Sept. 29-Oct. 1, 2017. The show runs three consecutive three-day weekends, Fridays-Sundays, (or as close to those dates as possible). Hours are Noon – 6 PM.

In consideration of TBA providing services in conjunction with HTE 2017,
the Builder agrees to and is bound by the following:

New Home Specifications: the home I am entering in HTE 2017:

A. Is a new home. (In case of a dispute, a copy of the building permit will be required.)

B. Has not previously been occupied and will not be occupied during HTE 2017.

C. Is located within the boundaries of TBA’s charter jurisdiction.
If not certain, please contact TBA for more information.

D. Will have a Wi-Fi connection, either by modem or a hot spot, for the ticketing devices.

E. Will be open for the entire event, during ALL official HTE 2017days and hours.

F. I, or my representative, know that we are expected to be present during ALL official days and hours of HTE 2017.

G. Will have a minimum of two people staffing the house (one for the front door/tickets, and one for providing information on the home).

For these purposes, “home” is defined as “HOUSE AND LOT IN A RESIDENTIALLY ZONED AREA OR LOCATED ON A RESIDENTIAL ZONED PROPERTY AND SITUATED ON A PERMANENT FOUNDATION. MUST HAVE A CERTIFICATE OF OCCUPANCY ON FILE.”

Fee Schedules

For the advertising and promotional expense of HTE 2017, I agree to pay the entry fee hereinafter checked. All materials are due by the dates listed below.

Early Registration: Monday, May 1 - Friday, June 30, 2017

$2,975 Early Registration for Tour Homes inside TBA’s geographic footprint

$3,675 Multiple Entry: discount applies only to two (2) Tour Homes per builder, per community

$2,475 Early Registration for Tour Homes outside TBA’s geographic footprint

Registration: Monday, July 3- Friday, July 14, 2017

$3,175 Registration for Tour Homes inside TBA’s geographic footprint

$3,875 Multiple Entry: discount applies only to two (2) Tour Homes per builder, per community

$2,675 Registration for Tour Homes outside TBA’s geographic footprint

Payment is due within 7 days of when the entry form is submitted to TBA. Payment must be made in full before you will receive your Parade Smart user name and password. TBA membership dues must be current.

I understand: If I direct show guests to visit houses I have not registered as HTE 2017 Tour Homes, I forfeit all rights to participate in the next HTE or Homearama single site event. All decisions by TBA are final.

I understand: It is recommended to submit Renderings & floor plans early, but the deadline is Friday, July 21, 2017. Submissions after this date may not be in the Tour Guide.

I understand: Changing elevation and floor plan for print materials after the entry has been submitted will be subject to a work order change fee of $250 per change.

No changes can be made to Tour Guide Listings, in the print magazine, after Friday, August 4, 2017.

Withdrawal Deadlines

I will notify TBA in writing of withdrawal if my Tour Home is sold prior to the opening day of HTE 2017(Friday, Sept. 15, 2017).

I understand: there is no refund for withdrawing from the event. No withdrawals or substitutions of homes will be allowed after Friday, August 4, 2017.

Property will be marked “SOLD” on the mobile app and in the Tour Guide – depending on the print deadline.

Entry Materials

I take full responsibility: for the accuracy of the information I have submitted to TBA and Parade Smart.

Tour Guide Listings (Print Magazine)

I understand: a proof of the half page Tour Guide listing will be emailed to me by TBA. All listing proofs must be approved and returned to TBA by Friday, August 4, 2017.

If the proof is not approved and returned by that date, any mistakes in the Tour Guide publication are my sole responsibility and liability. I further understand that TBA retains the right to edit any information it deems inappropriate for publication in the Tour Guide.

What TBA Provides

· My HTE 2017 home information will be featured on www.homearamatour.com and the Homearama Touring Edition mobile app.

· My tour home will have a half-page listing in the Tour Guide, featuring the front elevation and special features about the home.

· I will be given a large 3’x3’ yard sign to be placed in the front yard of my HTE 2017 home, during the show dates listed.

· I will be given 10 directional signs, with arrows, to be placed throughout the community of my HTE 2017 home, during the show dates listed.

· HTE 2017 Tour Guides and printed tickets will be provided for distribution in my tour home to be picked up at TBA.

· An electronic ticketing device with charger.

· Builder Information Packet.

Homearama Touring Edition: a Promotional Event

I understand: Homearama Touring Edition is a promotional event to spur the sale of new homes to the public.

I understand: The term and or logos for “Homearama Touring Edition” or “Homearama” may not be used by any entity (other than TBA) in any form of promotion such as open houses, print or media advertising, news or feature articles in the print or media, etc. without the written consent of TBA.

I understand: When an HTE 2017 tour house is also a show house for a special event (i.e., charity event, local print publication, etc.) written notification must be provided to TBA. All written, verbal and/or visual marketing promotions for the event must be approved by TBA and must state that the show house is a Homearama Touring Edition entry; HTE show dates must also be included.

Ready for Viewing by the Public

I understand : “Ready for viewing by the public” is defined as: the exterior complete and primary "living areas" open for viewing with the front and side yards landscaped and the back yard in the final grade stage. The interior, exterior, driveways, sidewalks and garages will be safe and free from debris. I understand that the landscaping MUST be completed with a "finished look," to include shrubs or flowers. Decorating the tour house is strictly my decision and responsibility. The house may be shown unfurnished, partly furnished or furnished.

I understand: my tour house must have direct access from the street.

Indemnification

I do hereby certify that I have obtained the legal rights to use the design from the copyright owner and to the design as represented in the structure, plans, specifications, and drawings for the home. I further represent that I have not pledged, assigned, or encumbered the rights to the design and that such design does not violate any copyright, property, or common-law rights of others. I hereby indemnify and hold harmless TBA from any and all claims of third parties, including, but not limited to, copyright infringement or conversion, which may be asserted as a result of the inclusion of the home in Homearama Touring Edition 2017, the inclusion of elevations or floor plans of the home in any publication of TBA or in conjunction with the mobile app used to promote Homearama Touring Edition 2017.

I agree to indemnify and hold TBA harmless from and against all claims, losses, costs, damages, expenses and liabilities for bodily injury, death, or property damage, arising out of or in connection with any and all occurrences on or about the home, caused in whole or in part by the other.

I do further promise to have a liability insurance policy in effect covering the Homearama Touring Edition 2016 during the time of the event and will provide a copy of a Certificate of Insurance to TBA “additional insured” no later than Friday, August 25, 2017.

Acts of God

I agree: in the event that an Act of God prevents performance by TBA or me, then that failure of performance shall not constitute a breach of this Contract.

I have read and do hereby agree to abide by the Rules and Regulations as set forth herein above for the Homearama Touring Edition 2017, by the HTE 2017 Committee and TBA. I understand that failure to comply subjects me to forfeiture of any and all privileges (including becoming ineligible to participate in future Homearamas and/or Tours), and in the event of any misunderstanding of this contract, agree to accept the decisions of the HTE 2017 Committee as final.

Note: Once the signed “Contract/Entry Form,” “Rules and Regulations” and “Copyrighted Materials Authorization” are accepted by TBA, the home is considered a registered entry and is subject to the rules outlined in this document.
