Alexandria Community Rowing 2010 Membership Agreement/US Rowing Waiver

This Membership Agreement is made this the day of _______________2010, between the Alexandria Crew Boosters Club, Inc., doing business as ALEXANDRIA COMMUNITY ROWING (ACR) and:

Hereinafter referred to as "Member'. ACR hereby grants Member license to use that part of the Alexandria Schools Rowing Facility and equipment designated for ACR's use subject to the ACR 2010 Membership Handbook and the following terms and conditions:

Section 1. Term, Deposit, and Fee

a) The term of the rowing membership shall be from March 31 to March 30 of the next calendar year. The rowing membership shall be prorated for the first year of membership, beginning on September 1 for the remainder of the year.

b) The rowing Membership Fee shall be $275.00 or as established by the ACR Steering Committee. An additional $45.00 fee is required for an annual Alexandria Crew Boosters (ACB) Membership. The ACB Membership is a family membership.

c) The membership fee shall not be refundable and shall not be transferable.

Section 2. Rights and Conditions

a) The Member has the right to use the shells of the club in accordance with the ACR rules governing the use of the shells. The rowing Membership Rules governing the use of shells shall be established and may be changed from time to time by the Steering Committee

b) The Member is responsible for the safe operation of the shells. Any damage to the shells shall be reported to the "Dockmaster" as soon as practical after the damage occurs.

c) The Member shall be responsible for the cost to ACR to repair or replace any damage caused by the Member to the shell, oars, riggers, or other parts of the equipment while the Member is in responsible charge of the shell.

Section 3. Use of Facility and Equipment

a) The member understands that at the dock, all boats will launch heading north and land from the south and, in general, maintain a clockwise traffic pattern on the Potomac River.

b) The member understands that boats coming from the south have the right-of-way for landing at the dock of the Alexandria Schools Rowing Facility. Boats coming from the north must make a 90-degree turn toward Robinson Terminal to enter the landing pathway for the dock of the Alexandria Schools Rowing Facility.

c) The Member agrees to volunteer to participate in the maintenance of equipment and/or activities that provide support for the Community Rowing Program.

Section 4. Renewal

This agreement may be renewed on a year-to-year basis through the payment by the member of the annual rowing membership fee. The amount of the annual fee shall be established each year by the ACR Steering Committee.

Section 5. Liability

The Member agrees that the Alexandria Crew Boosters Club, Inc., the Board of Directors of the Alexandria Crew Boosters Club, Inc., the City of Alexandria, The Alexandria Public Schools, The Alexandria City School Board or any of their employees shall not be liable for any loss, damage, or injury to the Outside Storage Area, or for injury to any person due to fire, theft, collision, windstorm, rain, snow, cold weather, accidents, Acts of God, acts of other persons or sue to any other cause not enumerated in this agreement.

Section 6. Water Safety

The Member attests that he or she can swim, can tread water for two minutes fully clothed, and can swim a distance of 100 yards. In the case of a single sculler, the sculler certifies that he or she has successfully passed a flip test.


Section 7. US Rowing Waiver Form

In consideration of being given the opportunity to participate in any Alexandria Community Rowing ("Club") activities ("Activity") until the end of this calendar year, I, for myself, my personal representatives, assigns, heirs and next of kin:

1. ACKNOWLEDGE, agree and represent that I understand the nature of Rowing Activities, both on the water and land based, and that I am qualified, in good health, and in proper physical condition to participate in such "Activity".

2. FULLY UNDERSTAND that: (a) ROWING ACTIVITIES INVOLVE RISKS AND DANGERS of serious bodily injury, including permanent disability, paralysis and death ("Risk'); (b.) These risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activity, the condition which the Activity takes place or the negligence of the Releases named below; (c) there may be other risks and social and economic losses either known to me or not readily foreseeable at this time and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Activity.

3. AGREE AND WARRANT that I will examine and inspect each Activity in which I take part as a member of the Club ant that, if I observe any condition which I consider to be unacceptably hazardous or dangerous, I will notify the proper authority in charge of the Activity and will refuse to take part in the Activity until the condition has been corrected to my satisfaction.

4. HEREBY RELEASE, discharge, and covenant not to sue US Rowing, the Club, their administrators, directors, agents, officers, volunteers, and employees, other participating regatta organizers, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place (each considered on the Releases herein) from all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releases or otherwise, including negligent rescue operations; and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, 1, or any one on my behalf, makes a claim against the Releases, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS, each of the releases from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such claim.

I have read this agreement, fully understand it's terms, understand that I have given up substantial rights by signing it and have signed if freely and without any inducement or assurance of any nature and intent it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
