NOTICE OF PUBLIC HEARING

Pursuant to the provisions of M.G.L. c. 12C and in accordance with M.G.L. c. 30A, as amended, the Center for Health Information and Analysis (CHIA) will hold a public hearing on Wednesday, January 27, 2016at 10:00 A.M. at 501 Boylston Street, Boston, MA 02116 relative to the proposal of regulation:

957 CMR 10.00: Health Care Payers Premiums and Claims Data Reporting Requirements

The proposed regulation, effective February 15, 2016, sets forth the filing requirements, procedures and timeframes for Private Health Care Payers (Payers)to report their aggregate commercial member months, premiums, claims and other data to CHIA. The proposed reporting requirements remain largely unchanged from those currently in effect. Differences include the establishment ofan explicit membership threshold which subjectsonly those Payers with at least 25,000 Massachusetts commercial members to the reporting requirements along with additional specifications on data submission procedures and related updates.Also, where feasible, CHIA may use currently reported and available data in addition to, or in place of, data that Payers are required to submit.Further, the data submissions of Payers must conform to the specifications set forth in the Data Submission Manual which is currently under development.

CHIA is proposing this regulation in order to implement the requirements of M.G.L. c. 12C, which directs CHIA to report on changes over time in health insurance premium levels, benefits, cost-sharing design, cost, and utilization. It is anticipated that Payers will incur no additional administrative costs to comply with these reporting requirements.There is no fiscal impact on cities and towns and no fiscal impact on small businesses.
