Responses to Verbal Questions

Q1)  Can the County define what vendors are considered local to Alameda County?

A1)  An Alameda County local vendor is a firm or dealer with fixed offices and having a street address within the County for at least six months prior to the issue date of any RFP being responded to; and which holds a valid business license issued by the County or a city within the County.

Q2)  Who are the SLEB subcontractors on the current contract?

A2)  The current SLEB subcontractors are Crosby and Overton, Stiles Paint Manufacturing, Inc., and EP Container Corporation.

Q3)  Can a vendor meet the SLEB requirement by subcontracting the labor portion of the contract?

A3)  Yes, vendors may subcontract with a SLEB for the labor portion of the contract. Vendors can search for SLEBs by using the County database located at http://acgov.org/sleb_query_app/gsa/sleb/query/slebindexadv.jsp. Vendors can also contact Linda Moore of OAP (510-208-9717 or ) for more information and/or guidance.

Q4)  Is the SLEB requirement only for the 10% preference or is it required for the contract?

A4)  The SLEB requirement is not only for a 10% preference. As stated on page 26 of the RFP, III (COUNTY PROCEDURES, TERMS, AND CONDITIONS), Section M (AWARD), Item 3:

Small and Emerging Locally Owned Business: The County is vitally interested in promoting the growth of small and emerging local businesses by means of increasing the participation of these businesses in the County’s purchase of goods and services.

As a result of the County’s commitment to advance the economic opportunities of these businesses, Bidders must meet the County’s Small and Emerging Locally Owned Business requirements in order to be considered for the contract award. These requirements can be found online at:

Q5)  What is the final date/time for submitting questions for this proposal?

A5)  According to page 17 of the RFP, II (CALENDAR OF EVENTS), the final date/time for submitting questions was by 5:00 p.m. on September 25, 2013.

Q6)  Can the County provide the rate that the incumbent is paying now?

A6)  The public may request copies of the current contract through a public records request. Public record requests for this project can be e-mailed to .

Q7)  Will the County accept another form of financial statements if the bidder is not a member of Dun & Bradstreet?

A7)  No, at this time the County can only accept a Dun & Bradstreet Supplier Qualifier Report. For information on how to obtain a Supplier Qualifier Report, contact Dun & Bradstreet at 1-800-424-2495 or http://www.dnb.com/government/contractor-management-portal.html

Q8)  Where, in the bid response, can a bidder attach the Disposal Matrix Bid Form?

A8)  The bidder can attach the form at the end of the bid response.

Q9)  Can the County define what a “Disposal Facility ID #” is on the Disposal Matrix Bid Form?

A9)  Please see Exhibit D – Disposal Site Qualifications, attached herein, for more information on Disposal Facility ID #’s.

Q10)  Can the County define what “bulking” means?

A10)  Bulking means removing paint and other materials from their original container and consolidating that material in larger containers, drums, or tanks. Typically, the products bulked are: Antifreeze; Photo-chemicals; Motor oil and compatible lubricants (into on-site fixed storage tank); oil based paint, Latex paint, and solvents. Paints and solvent bulking are performed in a flammable liquid dispensing room requiring worker to wear full face air purifying respirators with Organic Vapor cartridges, chemically impervious boots, impervious coveralls (typically Tychem QC or equivalent), and solvent resistant nitrile gloves and nitrile glove liners. Vendor supplied laborers must have appropriate respiratory protection training, fit testing (annual); and be issued with a respirator ( and proper Rx spectacles if required) cartridges and boots. Vendors laborers will be operating under the vendor’s respiratory protection program, with a vendor supplied “Qualified Person” to administer the program. The Household Hazardous Waste (HHW) Program will supply the other personal protective equipment (coveralls and gloves).

Q11)  How are the paint cans stored at the Household Hazardous Waste Facilities?

A11)  Paint cans are stored in DOT Specification or DOT Special Packaging 11624 authorized containers including 40 yard poly lined Roll-Off Boxes, Fiber DF Boxes, and 55 gallon drums. The HHW Program has limited space for Roll Offs. There are 5 Roll-Offs spotted at the facility at any given time: two at Oakland, two at Hayward, and a Roll-Off for Latex paint at Livermore.

Q12)  Will the County eventually ship the paint out directly from the cardboard boxes?

A12)  The HHW Program packs paint into containers for transport. The container used for packing will become the transport container.

Q13)  Will the County be defining how the one-day events will work or will they work in consultation with the vendor?

A13)  The setup and execution of one-day events will largely be the responsibility of the contractor. The HHW Program will arrange for the site and perform the outreach. The contractor will prepare the permit and site; unload, receive, sort, and package the waste; arrange the disposition of the waste in consultation with the program; and restore the site to its pre-event condition at the end. It is envisioned (but not required) that Paintcare eligible paint will handled by Paintcare at no packaging, transport, and disposal cost to the county. Other high volume wastestreams such as paint related material and non Paintcare eligible paint will be transported directly to the disposal site. Low volume (approximately 1-3 drums per event) waste streams such as acids, bases, PCB ballasts, batteries, oxidizers, and etc., may be transported to the facility for consolidation by the County at no disposal cost to the contractor.

To be clear, by suggesting the contractor utilize Paintcare for the disposal eligible paint products, and ship low volume wastestreams to one of the County facilities at no disposal cost, the HHW Program is attempting to lower the cost of one-day events and the overall cost to the HHW Program. The contractor is not obligated to take advantage of these cost saving strategies and may choose to handle all the waste by themselves, but price is one of the components that will be considered when evaluating one-day events.

Responses to Written Questions

Q14)  On the Disposal Matrix Bid Form, most of the print areas on the pricing sheets are not set to print the last three columns. Can the bidder modify the print area or will the County send out a revised Disposal Matrix Bid Form with the print areas set to the correct print area?

A14)  Bidders shall not modify the Disposal Matrix Bid Form in any way. Please see the REVISED Disposal Matrix Bid Form included with this Addendum.

Q15)  On the Disposal Matrix Bid Form, are there supposed to be calculation formulas for the Total (Turnkey Cost * Evaluation Quantities) column?

A15)  No, the Total Column has been removed. Please see the REVISED Disposal Matrix Bid Form included with this Addendum.

Q16)  Can the County clarify what the asterisk in the description for the Total (Turnkey Cost * Evaluation Quantities) column on the Disposal Matrix Bid Form means?

Q17)  Can the County explain what the term “Single Facility” in the Turnkey Cost column of 303 Category 9 Asbestos tab of the Disposal Matrix Bid Form means?

Q18)  Page 25 of the RFP, Section III (COUNTY PROCEDURES, TERMS, AND CONDITIONS), Section L (PRICING), Item 3 states:

The Pricing for all services and supplies shall be expressed in the unit price per container (for example Latex paint in 40 yd3 Roll Off Boxes: Cost for disposal shall include Roll Off Box rental, liners, and bracing materials).

Can the County provide the number of rental days for each bin since the rental rate will be wrapped into the turnkey rate?

A18)  There are always a total of five 40 yard Roll-off bins at the facilities at all times. Typically, when a contractor picks up a full bin, an empty bin is swapped in at the same time. The number of rental days per bin is 365 plus the number of days it takes for a full bin to be transported to the disposal site, the unloading time, and the time it takes to return the bin.

Q19)  Does the County anticipate any Roll Off boxes for non-PaintCare paint?

A19)  Yes; however, the HHW Facilities have space limitations with respect to bins. The Oakland facility is currently the only HHW Facility that can host an additional bin.
