EQUIPTO LIMITED LIFETIME WARRANTY
EQUIPTO warrants that products of its manufacture are designed to hold the distributed static load as shown in the current EQUIPTO product catalog posted on the EQUIPTO website. All shelving and racks units are designed to conform to Shelving Manufacturers Association deflection standards. EQUIPTO, in its sole discretion, shall repair or replace a component, which becomes distorted or suffers a permanent change while holding the uniform distributed load capacity warranted hereunder.
This warranty shall become effective only upon proper installation of the product in accordance with EQUIPTO’s printed assembly sheets. Except as otherwise provided herein, this warranty shall extend for the normal lifetime of the product, except for wear (Glides and Bearings) parts, mobile aisle systems, which are warranted for (5) five years, and purchased parts, which are subject to the original manufacture’s warranty, if any.
EQUIPTO’s obligations under this Warranty, and Buyer’s exclusive remedy, is solely limited to repairing or replacing, at EQUIPTO’s sole discretion, free of charge, FOB point of manufacture, any component part or parts which is determined by EQUIPTO to be defective under this Warranty. This Warranty does not apply to any unit, or part thereof, which in the sole discretion of EQUIPTO has been: (i) replaced, repaired or altered without EQUIPTO’s written consent, outside EQUIPTO’s factory or altered in any way so as, in the judgment of EQUIPTO, to affect adversely the uniform distributed static load capacity of EQUIPTO’s product: or (ii) the subject of misuse, negligence, or accident; or (iii) not installed other than in accordance with EQUIPTO’s printed instructions; or (iv) maintained in an environment which contributes to the deterioration of the raw material. This Warranty shall not cover costs in respect to labor required to disassemble or reassemble the unit, or damages to persons or property. As well, “Field Modification” outside of EQUIPTO engineering specification will void all Warranty coverage. No such agreement to replace or repair shall constitute an admission by EQUIPTO of any legal responsibility to affect such replacement or to make such repair. Buyer must notify EQUIPTO by registered mail or certified mail, return receipt requested, of a breach of this Limited Lifetime Warranty within (30) thirty days after discovery thereof, otherwise, such claim shall be deemed waived.
THIS LIMITED WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE, INCLUDING, WITHOUT LIMITATIONS, CONSEQUENTIAL DAMAGES OR WHETHER SUCH DAMAGES ARISE BY EQUIPTO’S NEGLIGENCE. THERE ARE NO WARRANTIES, WHICH EXTEND BEYOND THE TERMS OF THIS LIMITED LIFETIME WARRANTY AS EXPRESSLY STATED HEREIN. BUYER ACKNOWLEDGES THAT NO OTHER REPRESENTATION WAS MADE TO HIM/HER WITH RESPECT TO THE QUALITY AND FUNCTION OF THE UNITS SOLD UNDER THIS WARRANTY.
