2018 Single Farm Payment Entitlement Trading

We are now trading English Entitlements privately prior to the deadline, on the 15th May 2018. We are also trading Scottish Entitlements privately prior to the earlier deadline of the 2nd April 2018. The purchase of these entitlements will then enable the purchasers to claim on the entitlements under the Basic Payment Scheme for 2018 onwards.

If you are interested in trading Entitlements with us then please complete the attached Instruction Form and return it to us as soon as possible along with a screenshot of your 2017 RPA online entitlement balance in England or your 2017 SGRPID online entitlement balance in Scotland. We would like to draw your attention to our terms of business which can be found on the rear of the Instruction Form. In particular we ask that C & D Rural are instructed as Sole Agents to ensure that the same Entitlements are not traded twice by different Agents. All proceeds will be held by us as Stakeholder in a Clients Account until the transfer of entitlements has been processed either by the RPA or SGRPID. Our commission rate is based on 5% plus VAT of the total sale price of the Entitlements with a minimum commission of £150 plus VAT per transaction.

Please provide us with a screenshot or your 2017Scottish Government Rural Payments and Inspections Directorate (SGRPID) online entitlement balance to confirm that you hold these entitlements.

TERMS AND DECLARATION

I/We give an undertaking to grant C & D Rural permission to submit a Basic Payment Scheme entitlement transfer form to enable the transfer of the entitlements to take place. This permission not to be withdrawn until at least one month after completion of the transaction.

I/We agree to C & D Rural acting as stakeholders for any monies received from the buyer(s) of the entitlement until such time as SGRPID confirm that the transfer of the entitlement has been completed. I/We agree that C & D Rural are acting as sole agents for the entitlement detailed above and further agree that I/we will not withdraw this instruction except in writing and in any case not after C & D Rural have negotiated terms with a buyer whether or not they have informed me/us that a transaction has been agreed.

I/We authorise C & D Rural to deduct their commission which will be 5% for sales(subject to a minimum fee of £150 per transaction) from the proceeds of the transfers. In addition V.A.T. will be charged on the commission or fee at the standard rate applicable at the time of invoicing.

It is also agreed that although C & D Rural are expected to use their best endeavours to find a suitable buyer(s) for the above entitlements I/We will not hold them liable in the event that the entitlements are not traded before any deadline date.

I/We agree that should there be any problem with the transfer of the entitlement after submission of the transfer request to SGRPID, C & D Ruralwill be entitled to charge an additional fee for their time involved in resolving any problem.

I/We understand that in selling entitlements I am/we are entering into a binding contract with the Buyer and will sign the Sale/Purchase Agreement for this entitlement when asked to do so by the Agents. Should the transfer fail to be processed because I/We have provided incorrect information I/we will be liable to compensate the Buyer for all his reasonable losses.

I/We agree to assist C & D Rural however required, if C & D Rural need to take further action to obtain payment for this entitlement from the Buyer.

In confirmation that the information overleaf I/We have provided is both accurate and true, and the declaration has been fully read and understood, I/We now sign in acknowledgement.
