PROBLEMSTATEMENT:

Thevastmajority ofcriminaldefendantsintheUnitedStatesaretoopoortoaffordalawyer,yet adequate fundingandresources fordefensecounselremainsanelusivegoal. Fundingfortrial- levelcriminaldefenseinMichiganisprovidedentirelybycounties,eachselectingadifferent method;forappellate-levelcriminaldefense,counties fund75percentofdefenseservices,and theStateAppellateDefenderOffice(SADO)providestheremaining25 percent throughstate funding. Thelevelof financialsupportvaries widely fromcounty tocounty,andis generally consideredinadequatetoassuretheindigentdefendantsreceiveconstitutionally effective assistance ofcounsel. As a result, the delivery ofconstitutional-mandated defense services is widelydispersedanddisconnected. Localcommunitiesbearthecostsoferrorcorrectionwhen acasemustbe re-tried duetomistakesinthe firstproceeding. Mostimportantly,mistakescan leadtoconvictionofthewrongperson,leavingdangerousperpetratorsatlargeandcreating great risk to local communities.

PROGRAMDESCRIPTION:

This programarea is designed to improve poorly managed resources and case preparation. It hasbeendeterminedthatamajorityofcasesexoneratedorreceivingreducedsentencingdid nothaveanyinvestigationsatthetimeoftrial. In many ofthesecases,appellateinvestigations havelednotonlytojustoutcomes,butalsotheopportunitytofindandprosecutetheactual perpetratorofthe crime. InvestigatorscanprovideservicestorosterattorneysandSADO attorneysfor back-upandtrainingpurposes.

PREVIOUS GRANTCOMPLIANCE:

Themaximumstateawardunderthisprogramareawillbe$200,000.Allcostsmustbe reasonableandjustified.

LOCALBYRNEJAGAPPLICATION REQUIREMENT:

ApplicantsandanysubcontractorswhichappearonthefederalFY2017JAGAllocationsList are required tohavesubmittedaByrneJAGapplication tothe Department ofJustice.Applicants whichareeligiblefordirectByrneJAGawardsandwhichfailapply forthoseawardswillnotbe consideredfor fundingunderthisprogram.TheFY2017JAG AllocationsListisavailableonline at:

BUDGETDEVIATIONALLOWANCES:

Budgetdeviationallowancesarenotallowed. Allbudgetandprogrammaticchangeswill require a formalamendmenton theMichiganAutomaticGrantInformationConnectionPlus(MAGIC+) system.

UNALLOWABLEEXPENSESANDACTIVITIES:

All travel includingfirst classor out-of-state travel (unlesspre-authorizedundercertain programareas).

Anyadministrativecostsnotdirectlyrelatedtotheadministrationof thisgrantaward. Anyexpensesincurredprior tothedateof thecontract.

Compensationtofederal employeesfor travel orconsultingfees.Constructioncostsand/orrenovation (including remodeling).Contributionsanddonations.

Costsinapplying for thisgrant (e.g., consultants, grant writers, etc.).

oNote: No funding can be used to purchase food and/or beverages for any meeting, conference,training,orotherevent.Exceptionstothisrestrictionmaybemadeonly incases wheresuch sustenanceisnototherwiseavailable(e.g.,extremelyremoteareas),orwherea special presentationataconferencerequiresaplenaryaddresswherethereisnoother time forsustenance tobeattained.Suchanexceptionwouldrequirepriorapprovalfromthe DepartmentandtheU.S.DepartmentofJustice. IfthisapplicationisselectedforaByrneJAGaward,therequirementsbelowmustbefollowed. Failure todosomaycauseyouraward tobesuspendedor revoked.

PERFORMANCE/PROGRESS/PERFORMANCEMEASUREMENTTOOL(PMT)REPORTS: Progressreportingwilltakeplacenolaterthan20daysaftertheendofeachquarterthrough thefederalPMTsystemlocatedat: Ifapplicable,another programprogressreport(alsoduenolaterthan20daysaftertheendofeachquarter)mustbe submittedandwillincludeperformanceonimplementation,activity,goals,andobjectivesas well as metricsspecific to theprogram area.

AllPerformance/Progress/PMTReports mustbe completed throughMAGIC+by the 20th day aftertheendofeach quarter. Itisthegranteesresponsibilitytofamiliarizethemselveswiththe requirements of the Performance/Progress/PMT Reports, which are contained within an awardedcontract.

FINANCIALSTATUSREPORTS (FSR)(REQUESTFOR REIMBURSEMENT):
