A.REGISTRATION OFRIDERSANDAGREEMENTPURPOSE-I,thefollowinglistedindividual,and/ortheparentorlegalguardiansthereofifaminor,doherebyagree torentfrom the Company ahorse,tackandequipment,personnelandinstructionforthepurposeofhorsebackridingtodayandonallfuturedates. For consideration received, and in return for the use, today and on all future dates of the property, facilities and services of the Company, Rider/legal guardian, hereby agree as follows:

B.AGREEMENTDEFINITIONS-ThisAgreementshallbelegallybindinguponmetheregisteredrider,andtheparentsor legalguardiansthereofifaminor,myheirs,estate,assigns,includingallminorchildren,andpersonalrepresentatives;anditshallbeinterpretedaccordingto thelawsofthestateofTexas.Ifanyclause,phraseorword is inconflictwithstatelaw,thenthatsinglepartisnullandvoid.Theterm'Horse'hereinshallrefertoallequinespecies.Theterm‘Horseback Riding'hereinshallreferto riding,drivingorotherwisehandling,grooming,andgeneralcareofhorses,ponies, mules,ordonkeys,whetherfromtheground,thecart,or mounted.Theterm'Rider'shallhereinreferto apersonwhoridesaHorsemountedordrivesin acartorotherwisehandlesorgroomsorcomesnearaHorsefromtheground.Theterms'I','Me''My'shallhereinrefertothe aboveregisteredRiderandthe parentsorlegalguardiansthereofifaminor.
C.ACTIVITYRISKCLASSIFICATION-I understand that: Horseback Riding is a dangerous activity and involves the risk of serious injury and/or death and/or property damage. I understand that therearenumerousobviousandnon-obviousinherentrisksalwayspresentinHorseback Ridingdespiteallsafetyprecautions.I acknowledge that any injuries that I sustain may be compounded by negligent emergency response or rescue operations of the Company. I acknowledge that I am voluntarily participating in the activities with the knowledge of the danger involved and hereby agree to accept and assume any and all risks of injury, death or property damage, whether caused by the negligence of the Company or otherwise. I agree and understand that the Company cannot control the Horses it boards, and that I shall release and hold harmless Company from any injury arising out of or related to equine activities at Company’s facilities.
D.NATUREOFHORSES-Iunderstand that:the Companychooses the Horses foritsschoolfortheircalmdispositionsandsoundbasictrainingasisrequiredforuseasridingHorsesfornoviceandbeginningRiders, yet,noHorseisa completelysafeHorse.IfaHorseisfrightenedorprovokeditmaydivertfromitstrainingandactaccordingtoitsnaturalsurvivalinstinctswhichmay include,butarenotlimitedto,stoppingshort,changingdirectionsorspeedatwill,shiftingitsweight,bucking,rearing,kicking,biting,orrunningfromdanger. IunderstandtheunpredictabilityofHorsesandagree toassumeall riskinherentinHorseback Riding.
E.RIDERRESPONSIBILITY- I understand that:UponmountingaHorse,theRiderisinprimarycontrolof theHorse.TheRider'ssafetylargelydependsuponhis/herabilityto carryoutsimpleinstructions;andhis/herabilitytoremainbalancedaboardthemovinganimal.IagreethattheRidershallbe responsibleforhis orherownsafetyandthatofanunbornchildiftheRiderispregnant.The CompanyadvisespregnantwomennottorideHorses,unlesspermission isgivenunderadviceofherphysician.
F.CONDITIONSOFNATURE- I understand that:The Companyis not responsiblefortotalorpartialacts,occurrences,orelementsofnaturethatcanscareaHorse,causeitto fall,orreactinsomeotherunsafeway.Some examples include, but are not limited to,thunder,lightning,rain,wind,water,wildanddomesticanimalinterference,insectsand/orreptiles,whichmay walk,run,orflynear,orbiteorstingaHorseorperson;andnaturalandman-madechangesin landscape.
G.CARRY-ONOBJECTSANDSHARPNOISES-Iunderstand that:Riders mustnotcarrylooseitemswhileridingwhichmayfall,blowaway,flapin thewind,bounce,ormakesharpnoises,possiblyscaringaHorse.Some examples include, but are not limited to,theuseofcellularphones,camerasandjewelry. Ridersmustnot makesharp,loudnoises,suchasscreamingoryelling,whichmayscareaHorse.
H.ACCIDENT/MEDICALINSURANCE-Iagree that:Shouldemergencymedicaltreatmentberequired,Iand/ormyown
accident/medicalinsuranceCompanyshallpayforallsuchincurredexpenses.Myaccident/medicalinsuranceCompanyis______andmypolicynumberis ______.In theeventofanaccidentorinjuryIauthorizethe Companytogiveand/orarrangeforemergencymedicaltreatmentasneeded.
I.PROTECTIVE HEAD GEAROFFERING- I,for myselfandonbehalfofmychildand/orlegalward,havebeenofferedprotectiveheadgear(EquineSafetyHelmet)by the Companyanddounderstandthatthewearingofsuchheadgearwhilemounting,riding,dismountingandotherwisebeingaroundHorses,maypreventor,reduceseverityofsomeheadinjuries,andmayevenpreventdeathastheresultofafallorotheroccurrence.Itisunderstoodthatprotectiveheadgear provided by the Companymaynotbe aperfectfit foreachRider'shead,andthatonceprovidedI/Wewillberesponsibleforsecuring thehelmetonthisRider’sheadatalltimes.AllRidersarerequiredto wearan EquineSafetyHelmetatalltimeswhenriding.
[ ] PROTECTIVEHEADGEARACCEPTANCE:I/WEREQUESTTO WEARPROTECTIVEHEADGEARWHICH THE COMPANYPROVIDES.
[ ] SELF-PROVIDEDPROTECTIVEHEADGEAR:l/WEWILLPROVIDEMY/OUROWNPROTECTIVEHEADGEAR.
J.EQUIPMENTNEEDS-The CompanyrequiresthatallRidersbeproperlyfittedforthepurposeof riding. Properdressincludeslong pants,hardsoledridingbootsandanEquineSafetyHelmet. Iagreeto furnishformyselforminorchildtheproperequipmenttomakeridingsaferandmorecomfortable.
K.GOVERNING LAW AND VENUE. This Agreement shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction) that would cause the application of Laws of any jurisdiction other than those of the State of Texas. Any legal suit, action or proceeding arising out of or based upon this Agreement or the transactions contemplated hereby may be instituted in the courts of the State of Texas, County of Dallas, City of Dallas, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding.
L.LIABILITYRELEASE:I hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Company, and its officers, directors, employees, agents, affiliates, successors and assigns (collectively, "Releasees"), on account of injury, death or property damage arising out of or attributable to my participation in Horseback Riding, whether arising out of the negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasees, and forever release and discharge the Company and all other Releasees from liability under such claims.
M.HOLD HARMLESS:I shall defend, indemnify and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees and the costs of enforcing any right to indemnification under This Agreement and the cost of pursuing any insurance providers, incurred by/awarded against indemnified party in a final, non-appealable judgment, arising out or resulting from any claim of a third party related to Horseback Riding.
N.SUCCESSORS AND ASSIGNS:This Agreement is binding on and shall inure to the benefit of the Company and me and their respective successors and assigns.
I/WE HAVE READ FULLY AND UNDERSTAND COMPLETELY THIS AGREEMENT, WARNINGS, RELEASE AND ASSUMPTION OF RISK. I/WE FURTHER ATTEST THAT ALL FACTS RELATING TO THE RIDER’S PHYSICAL CONDITION, EXPERIENCE AND AGE ARE TRUE AND CORRECT. BYSIGNINGTHISAGREEMENT,IAMGIVINGUPCERTAINLEGALRIGHTS,INCLUDINGTHERIGHTTORECOVERDAMAGESINCASEOFINJURY,DEATH,ORPROPERTYDAMAGE,ARISINGOUTOFMYorMYCHILD'SPRESENCEAND/ORPARTICIPATIONINEQUINEACTIVITIESATTHE COMPANY,INCLUDINGINJURY,DEATH,ORPROPERTYDAMAGEARISINGOUTOFTHE NEGLIGENCE OF THE COMPANY. I HAVE READTHISAGREEMENTCAREFULLYBEFORESIGNINGIT.MY SIGNATUREINDICATESMYUNDERSTANDINGOFANDAGREEMENTTO ITSTERMS.
