GENERAL.

Notices have been placed at all racetracks in relation to unregistered substances. The Industry has also been notified via the ORI website and in the Harness Racer. Participants are on notice that monetary penalties may be issued to persons found in possession of unregistered substances.

On December 15 Stewards conducted an inquiry into the results of analysis of samples taken from driver Dylan Ford at the Launceston Pacing Club meeting on October 4 2015. Evidence was taken from David Batty, laboratory Director of Racing Analytical Services Limited and from Mr Ford.

Mr Ford pleaded guilty to a charge under the provisions of AHRR 250(1)(a) which states “ A driver commits an offence if a sample taken from him is found upon analysis to contain a substance banned by Rule 251.” The particulars of the charge were that samples taken from Mr Ford on that date were found to contain Ritalinic Acid, a metabolite of Methylphenidate, which is a prohibited substance.

In determining penalty Stewards considered Mr Fords guilty plea, his co-operation during the inquiry and that it was a first offence. Also taken into consideration were Mr Ford’s personal circumstances and the penalty guidelines for like offences which were published in May 2014.

Also taken into consideration was the fact that the substance was a stimulant and the importance of participants being drug free due to the exacting nature of race driving which entails a high degree of risk. Mr Ford’s licence to drive in both races and trials was suspended for five months which was backdated to commence on November 6, on which date he was stood down. His suspension will expire at midnight on April 5 2016. Mr Ford has provided a clearance sample allowing him to drive trackwork and was also advised of his rights of appeal.

A Crowther.
