1.  Awarded North American Industry Classification System (NAICS) and Business Size: 541930, Small Business.

2.  The attached Commercial Sales Practice (CSP) Format dated 4-07-2016 and Price Proposal List (PPL) are attached hereto and are hereby incorporated into the contract. The Contractor’s Most Favored Customer(s) are Bridgerock Capital, Efficas, Egyptian Imports, Heinrich Hispanidad, Intercambio Uniting Communities, Minnesota Dept of Health, National Kidney Foundation, RRC Associates, Vail Resorts, Wallstreet on Demand, and Wholefoods Market (Ideal) and these customers receive discounts of 0.0 to 23.8% off the Contractor’s commercial market rates/commercial price list. GSA contract prices are discounted 1.04 to 15.0% from the MFC prices, excluding the required 0.75% IFF.

3.  Basis of Award: In order to fulfill clause 552.238-75 (Alternate I), Price Reductions, the Government established Minnesota Dept of Health, Sheraton Hotel Denver, Intercambio Uniting Communities, Egg Strategy, National Kidney Foundation, National Energy Board of Canada, Heinrich Hispanidad, Egyptian Imports, Wallstreet on Demand, RRC Associates, Efficas, CH2M Hill, Bridgerock Capital, Vail Resorts, Terralliance, Spitfire Communications, Wholefoods Market, Noodles, Hotel Monaco, Housing Helpers, and Courtyard by Marriott. as the Company’s Basis of Award (BOA) and GSA prices, excluding the required .75% Industrial Funding Fee (IFF) are 1.04 to 15.0% less than the prices charged to the BOA.

Any change in the Contractor’s commercial pricing or discount arrangements which disturbs this relationship may constitute a price reduction and must be reported to the GSA Procurement Contracting Officer (PCO).

Below is the hourly pricing for the labor categories awarded under the SINs (as shown in item #2 above). These prices will continue in effect until revised in accordance with clause I-FSS-969 (b) (2) All prices include the 0.75% IFF.

5.  Service Contract Act:

a.  Lanza Language, Inc. certifies the GSA awarded rate meets or exceeds the minimum wage rate as identified in Wage Determination 1987-0989 currently incorporated into PSS Solicitation for the SCA non-exempt labor categories identified in the matrix below.

The Service Contract Act (SCA) is applicable to this contract and it includes SCA applicable labor categories. The prices for the cited SCA labor categories are based on the U.S. Department of Labor WD Number(s) identified in the SCA matrix. The prices offered are based on the preponderance of where work is performed and should the Contractor perform in an area with lower SCA rates, resulting in lower wages being paid, the task order prices will be discounted accordingly.

b.  Should the Contractor propose in an area with higher SCA rates or is subject to a Collective Bargaining Agreement (CBA) in accordance with FAR 22.1008-2, resulting in higher wages being required that exceeds their approved GSA rate, the Contractor will notify their Procurement Contracting Officer (PCO) and submit a modification to their contract via the eMod system accordingly.

In accordance with clause 52.222-41, SCA does not apply to any labor category that is performed outside the United States which is defined as all 50 States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, Johnston Island, Wake Island, and Outer Continental Shelf lands as defined in the Outer Continental Shelf Lands Act (43 U.S.C. 1331, et seq.), but does not include any other place subject to U.S. jurisdiction or any U.S. base or possession in a foreign country (29 CFR 4.112).

9.  Clause 552.238-74 Industrial Funding Fee and Sales Reporting: In accordance with clause 552.238-74, the Contractor must report the quarterly dollar value of sales under the contract by calendar quarter on electronic GSA Form 72A, Contractor's Report of Sales, to the FSS Vendor Support Center (VSC) Website at Internet, http://VSC.gsa.gov. If no sales occur, the contractor must show zero on the report.

Note: Failure to update your electronic file submission in accordance with contract clause 552.238-81Modifications (Federal Supply Schedule)(formerly 552.243-72Modifications (Multiple Award Schedule) will adversely impact the customer’s ability to utilize your services.
