I ACCEPT THE 2015 Bay Harbor Ice Fest PLANNING CONSIDERATIONS, ICE SCULPTING RULES AND THE FOLLOWING LIABILITY WAIVER & ARTISTIC RELEASE. LIABILITY WAIVER: The undersigned ice sculpting competitors, individually recognize and acknowledges the existence of various known and unknown risks to person and property that are inherent in the participation in ice sculpting and its attendant activities. Notwithstanding the foregoing, the undersigned has elected to participate in 2015 Bay Harbor Ice Fest and accepts the conditions listed in the agreement above. I also accept all such risks. In consideration of the acceptance of the undersigned as a sculptor in the Festival, I do personally and individually, for myself, my heirs, executors and legal representatives, waive and release any and all rights and claims for damages or injuries that I may have against the Festival, the City of Bay Harbor and 2015 Bay Harbor Ice Fest, each of the officers, directors, members and agents of the aforementioned and all other persons or organization affiliated with the foregoing and I do agree to indemnify them and hold them harmless from and against any claims, liabilities, disputes, lawsuits, actions, costs, including attorney’s fees and expenses that may arise, are related to, or are caused by my participation in the 2015 Bay Harbor Ice Fest for any cause or reason whatsoever. I am responsible for my own medical coverage and realize 2015 Bay Harbor Ice Fest provides no coverage for me should I become sick or injured while participating in the 2015 Bay Harbor Ice Fest. ARTISTIC RELEASE: Sculptor herby grants exclusive right and permission without additional compensation to any and all the aforementioned persons to use any photographs, videotapes, motion pictures, recordings of my self and or sculptures for any purpose whatsoever, including promotional or commercial purposes.
