Amend text as follows:
Of the total commitment appropriations in this item, an amount of EUR 1305700000 results from the compulsory modulation in conformity with Article 10 of Council Regulation (EC) No 1782/2003 of 29 September 2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers (OJL270, 21.10.2003, p.1). In addition an amount of EUR 424000000 results from the voluntary modulation in conformity with Regulation (EC) No 378/2007 (OJ L 95, 5.4.2007, p.1). Rural development measures under all axes will be measured against more refined performance indicators for farming systems and production methods so as to respond to the challenges related to climate change, water protection, biodiversity and renewable energies.

In accordance with the EU's commitments under the Treaty on Plant Genetic Resources, the establishment of a European open data and pooling bank for traditional plant varieties should be encouraged which will enable nongovernmental organisations and private and public-sector bodies to set up, alongside Member States' national gene banks, a seed pool for traditional varieties which are particularly valuable for preserving biodiversity in agriculture and for producing quality foodstuffs.

Justification:
Currently, the RAL for this budget line amounts to almost 9000 million. Due to the large amount unspent from former budgetary exercises, the appropriations for payments should be increased by 500 million, in addition to restoring the PDB.
The proposed data and pooling bank is intended in particular to collect data on plant varieties, making them publicly accessible, which do not come under the licensing and marketing criteria for certified seed, but, rather, are used to preserve traditional plant varieties. The EU's seed marketing legislation should be adapted accordingly.
More refined performance indicators are necessary to meet the new four challenges listed in the Commission's legislative proposals for the Health Check.
The level of payment appropriations has to be adapted to better implement EU policies.
BUDG has taken over and modified the amendments tabled by the rapporteur, AGRI and Verts/ALE.

It is necessary to make provision, as stated in Commission communication COM(2008) 453 of 8 July 2008 on promoting the adaptation of the European Union fishing fleet to the economic consequences of high fuel prices, for the possible creation of a temporary ad hoc financial instrument so as to make available, where necessary, additional resources on top of those earmarked by the EFF.

The Council has approved measures to adapt the Community fleets to the economic situation resulting from the increase in the price of fuel. In this context, the above-mentioned communication already makes provision, should the EFF funding allocation to finance those measures prove insufficient, for the possible creation of a temporary ad hoc financial instrument. Provision should therefore be made in the budget, too, for the possible creation of that instrument.

–preparatory work on new international fisheries organisations (South Indian Ocean Fisheries Agreement, South Pacific Regional Fisheries Organisation, etc.),
international fisheries organisations in which the European Community has observer status (Article 37 of the Treaty on European Union and Article 310 of the Treaty establishing the European Community):
–Inter-American Tropical Tuna Commission (IATTC),
–the International Whaling Commission (IWC),
–the Organisation for Economic Cooperation and Development (OECD),
–supporting the follow-up and implementation of some regional projects, notably by contributing to specific joint international control and inspection activities. This appropriation should also cover surveillance programmes to be negotiated in West Africa and the Western Pacific.

Justification:
The surveillance programme in the SW Indian Ocean should be continued and similar programmes created in other regions notably West Africa and the South Pacific, two areas where the EU has extensive networks of fisheries agreements. These programmes should continue through 2010 and beyond as part of the campaign against illegal fishing.

–expenditure for partnership contracts with national research institutions for the provision of scientific advice,
–expenditure for administrative arrangements with the Joint Research Centre, or any other Community consultative body, to provide the secretariat for the Scientific, Technical and Economic Committee for Fisheries (STECF), to conduct the pre-analysis of the data and to prepare the data to evaluate the situation of the fisheries resources,
–indemnities paid to the members of the STECF, and/or the experts invited by the STECF for their participation and work performed during the working groups and plenary sessions,
–indemnities paid to independent experts providing the Commission with scientific advice, or providing training to administrators or stakeholders in the interpretation of the scientific advice,
–contributions to international bodies in charge of stocks assessments and for providing scientific advice.
–surveys of the population of cormorants on the territory of the European Union in preparation for regular monitoring in the future.

Justification:
The cormorant is a naturally occurring bird species and is covered by Directive 79/409/EEC. The published figures for the present population vary between 600 000 and two million. The daily average weight of fish taken is 500 g; the figures for the volume of fish stocks taken vary accordingly. With a view to a possible population management plan, a Europe-wide survey of the population of the species Phalacrocorax carbo carbo and Phalacrocorax carbo sinensis would appear necessary.
