2010 Raffle Official Rules and Regulations
Boys & Girls Club of El Sobrante, Inc. a nonprofit California corporation, is a tax-exempt organization under federal and state laws. The Boys & Girls Club of El Sobrante exists to provide after-school athletic and educational programs for boys and girls between the ages of seven to seventeen years old in West Contra Costa.
The Boys & Girls Club of El Sobrante is conducting this raffle pursuant to California Penal Code Section 320.5, et seq., as a way to raise funds to cover a portion of the cost of providing The Boys & Girls Club of El Sobrante’s services to the community. The official rules and regulations of the The Boys & Girls Club of El Sobrante raffle are set forth below. By purchasing a raffle ticket, you agree to be bound by these rules and regulations. The Boys & Girls Club of El Sobrante’s interpretation and application of the rules and regulations shall be final.
Tickets
Raffle tickets are $5 each or 5 for $20, payable to “The Boys & Girls Club of El Sobrante”. Raffle tickets must be purchased by 3 p.m. on Sunday, September 19th, 2010. All sales transactions are final. Only ticket holders with validly paid tickets are eligible to participate in the raffle. Any purchase requests received with payment after 3 p.m. on Sunday, September 19th, 2010 will be returned. No other refunds are available. The Boys & Girls Club of El Sobrante assumes no responsibility for lost, late, misdirected or non-delivered mail or other failure to deliver tickets prior to any deadline. Purchases of raffle tickets are not tax-deductible contributions.
How to Purchase
Tickets may be purchased from an employee or agent of The Boys & Girls Club of El Sobrante, and paid for by cash, check or credit card. Purchases may be made in person or by mail to The Boys & Girls Club of El Sobrante Vacation Raffle, P.O. Box 20090, El Sobrante, CA94820. You may call 510-223-5253 for more information. Selection of Winner
The winning ticket will be drawn at random on or about 3 p.m. on Sunday, September 19th, 2010 from all eligible raffle tickets received. The Boys & Girls Club of El Sobrante will conduct the drawing. Ticket holders do not need to be present to win. The winner will be notified by phone, U.S. mail or email, according to the contact information provided to The Boys & Girls Club of El Sobrante at the time of ticket purchase. The odds of winning the prize will depend on number of raffle tickets sold.
Eligibility
You must be 18 years of age or older and be a legal resident of the United States to purchase tickets or win the prizes. Employees of the Boys & Girls Club of El Sobrante, their spouses and dependents are not eligible to win the prize. All federal, state, and local laws and regulations apply. The raffle is void where prohibited or restricted by law.
Prizes
The Grand Prize is a 7 day Caribbeanor Mexican cruise for two on Holland America Line and two roundtrip tickets on Southwest Airlines. Second Prize includes a two night stay at the Golden Nugget in Las Vegas and two roundtrip tickets on Southwest Airlines. Other prizes include hotel stays at Harrahs/Harveys in Lake Tahoe, Atlantis in Reno, Larkspur Hotels, Beach Resort in Monterey, Dry Creek Inn in Healdsburg, The Stanford Inn in Palo Alto, Courtyard Marriot at Vallejo/Napa Valley, and dinner and wine tasting certificates. Restrictions
No substitutes for prizes will be made. Some prizes do have restrictions. Please contact the office for specific details. The winner assumes all local, state and federal income taxes and incident expenses not mentioned herein. Completion of a W-9 will be required at the time of transfer of the prizes to the winner. If the winners cannot be located by 5:00 p.m., November 19th, 2010, after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winners will be deemed to have forfeited his or her prize, and another winner will not be selected for such prize. The winner must claim his or her prize within fourteen (14) days after notice of the award. If the winner does not claim the prize within such fourteen (14) day period, such winner will be deemed to have forfeited his or her prize and another winner will not be selected for such prize. The name of the winners may be obtained by a request, in writing, to The Boys & Girls Club of El Sobrante, together with a self-addressed, stamped envelope, not later than November 30, 2010.
General Terms and Conditions
By purchasing a raffle ticket, you agree to be bound by these Official Rules and Regulations and the decisions of The Boys & Girls Club of El Sobrante, which shall be final. The winners will be required to execute an affidavit of eligibility and a publicity release permitting The Boys & Girls Club of El Sobrante to use their name, photograph, likeness and voice for promotional purposes in any media. The Boys & Girls Club of El Sobrante is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. By entering the raffle, each participant releases The Boys & Girls Club of El Sobrante, its directors, officers, employees, and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and the winner agrees to indemnify and hold The Boys & Girls Club of El Sobrante harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.
Disclaimer of All Other Representations and Warranties
THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS. THE BOYS & GIRLS CLUB OF EL SOBRANTE DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RAFFLE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. A RAFFLE PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR THE BOYS & GIRLS CLUB OF EL SOBRANTE’S BREACH SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER RAFFLE TICKET(S).
IN NO EVENT SHALL THE BOYS & GIRLS CLUB OF EL SOBRANTE BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF THE BOYS & GIRLS CLUB OF EL SOBRANTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ANY CLAIM OR DISPUTE AGAINST THE BOYS & GIRLS CLUB OF EL SOBRANTE WITH RESPECT TO THE RAFFLE MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ARISES.
