A JOINT RESOLUTION

TO ESTABLISH A COMMITTEE TO STUDY ALL EARMARKED AND RESTRICTED ACCOUNTS OF THE STATE, TO PROVIDE FOR ITS MEMBERSHIP AND DUTIES, TO REQUIRE THE COMMITTEE TO MAKE A REPORT OF ITS FINDINGS WITH RECOMMENDATIONS TO THE GENERAL ASSEMBLY, AND TO PROVIDE FOR ITS DISSOLUTION.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION1.There is created a committee to study and make recommendations to the General Assembly with respect to this state’s earmarked and restricted accounts, as defined by the records of the Comptroller General. The committee shall consist of twelve members as follows:

(1)three members appointed by the Speaker of the House of Representatives;

(2)three members appointed by the President Pro Tempore of the Senate;

(3)three members appointed by the Chairman of the House Ways and Means Committee; and

(4)three members appointed by the Chairman of the Finance Committee.

A member may be from the public or private sector, and if a member of the General Assembly is appointed, that legislator may serve notwithstanding Section 813770. The committee shall choose its officers and must be provided with clerical, administrative, and research services by the House of Representatives and the Senate and other agencies as needed. The committee shall examine issues relating to all earmarked and restricted accounts of all state agencies as identified by the records of the Comptroller General. The committee shall produce a report with recommendations and forward that report and recommendations to the General Assembly no later than January 9, 2007. Members of the committee shall serve without compensation, but are allowed the mileage, subsistence, and per diem allowed by law for members of state boards, committees, and commissions, to be paid equally from approved accounts of the House of Representatives and Senate. The committee terminates on January 9, 2007, or the date it forwards its report and recommendations to the General Assembly, whichever is earlier.

SECTION2.Pending the filing of the report and recommendations required pursuant to Section 1 of this joint resolution, the following Statewide Accounting and Reporting System (STARS) subfunds are exempt from the provisions of Section 7, Act 156 of 2005:

(1)Department of Motor Vehicles

Subfund 3264 Operating Revenue

(2)Comptroller General’s Office

Subfund 4007 Unemployment Compensation

(3)State Accident Fund

Subfund 4033 – Workers’ Compensation Fund

(4)Budget and Control Board

Subfund 4161 Insurance Reserve Fund

(5)Budget and Control Board

Subfund 4202 State Life and LTD.

SECTION3.This joint resolution takes effect upon approval by the Governor.
