AN ACT TO AMEND SECTIONS 5615350, 5616180, AND 5619240, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DENIAL, SUSPENSION, OR REVOCATION OF A DRIVER’S LICENSE, AND AN APPLICATION FOR A CERTIFICATE OF TITLE FOR A MOTOR VEHICLE, SO AS TO REVISE A REFERENCE TO A PROVISION OF FEDERAL LAW.
Be it enacted by the General Assembly of the State of South Carolina:
Revision to a reference to federal law
SECTION 1. Section 5615350(f) of the 1976 Code is amended to read:
“(f) Been found by a court of competent jurisdiction to have violated any federal or state law regarding the disconnecting, resetting, altering, or other unlawful tampering with a motor vehicle odometer, including the provisions of 49 U.S.C. 3270132711 (Title 49, Subtitle VI, Part C, Chapter 327);”

SECTION 2. Section 5616180(f) of the 1976 Code is amended to read:
“(f) Been found by a court of competent jurisdiction to have violated any federal or state law regarding the disconnecting, resetting, altering, or other unlawful tampering with a motorcycle odometer, including the provisions of 49 U.S.C. 3270132711 (Title 49, Subtitle VI, Part C, Chapter 327);”
Revision to a reference to federal law
SECTION 3. Section 5619240(4) of the 1976 Code is amended to read:
“(4) A person who knowingly gives a false statement on the application or knowingly gives a false statement concerning the odometer reading on an odometer disclosure statement is guilty of a misdemeanor and, upon conviction, is subject to a fine of up to one thousand dollars or imprisonment of up to one year, or both. These penalties are in addition to the penalties provided by the federal odometer law 49 U.S.C. 3270132711 (Title 49, Subtitle VI, Part C, Chapter 327).”
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
