Rules Governing Use of Pinegate Swimming Pool Facilities
Admission and Guest Privileges
Only Members in good standing, members of their immediate family, and their guests may use the pool facilities subject to the provisions of the pool rules.
A guest is someone who does not live at the residence of the Homeowner.
All guests must register with the Pool Manager or lifeguard-on-duty when entering the facility.
Members/Homeowners must use guest passes to admit their guests to the pool facilities. Homeowners may purchase guest passes for $2.00 per day for each guest as needed. Trustees may restrict future use of the pool facilities to Homeowners who do not follow this policy.
Homeowners must notify the Pool Manager 48 hours in advance if they are inviting 10 or more guests to use the pool facilities for a function. This will give the pool manager time to arrange adequate lifeguard coverage. Homeowners may have to pay for additional lifeguards.
Swim Team Marathon – 10PM – 7AM – does not affect pool hours
Lifeguards may request guests to demonstrate their swimming ability.
A Member or someone from a Member’s immediate family must accompany their guests at all times.
Members have responsibility for their guests at all times, including liability for damages to Pinegate Homeowners’ Association property caused by their guests.
Pool Use
Use the pool only in the presence of an on-duty lifeguard with their knowledge and approval.
The lifeguard-on-duty may refuse entry or eject any person form the pool area at any time at their discretion. Lifeguards will notify parents as required. Concerned parties can appeal to the Pool Manager or a Trustee.
Persons with open sores, inflamed eyes, infections, or pose other health or safety risk may not use the pool.
Children under 6 years of age or 42” tall may not remain in the enclosed pool area unless accompanied by a responsible caregiver approved by the child’s parent, or the lifeguard-on-duty determines that the child can pass a swimming test.
Only children under 5 years of age or 42” tall may use the baby pool. Older, taller children may use the baby pool only if supervising a younger, smaller child.
Use plastic or vinyl pants or special swimming diapers with elastic waist and legs if any question remains about a child’s toilet training. Do not use disposable diapers as swimsuits.
Do not smoke within the enclosed pool area.
Do not use glass containers within the enclosed pool area.
No alcohol is permitted within the enclosed pool area.
Keep pets outside the enclosed pool area.
The Pool Manager, lifeguard-on-duty, or Trustee may close the pool at their discretion due to cold temperatures (below 65° F), inclement weather, lightening storm, water quality issues, or safety factor.
Lifeguards will close the pool for a minimum of 30 minutes following signs of lightening or thunder.
The Pool Manager, Lifeguard-on-duty or Trustee may re-open the pool at their discretion following state and local laws, and using local practice as a guideline.
Only lifeguards and other authorized persons may enter the pool office and equipment room.
Rest Periods
A lifeguard will call a 15-minute break each hour, from the 45 minutes mark to the top of the hour. Children under 18 must exit the pool. Adults 18 and older may continue to swim. Children may not swim with an adult in the pool on a one-to-one basis.
Safety Precautions
· No running within the pool area at any time.
· No throwing of children whether family or not.
· No pushing, dunking, or jumping on swimmers permitted.
· Use only lifeguard-approved flotation devices or other objects in the pool. This includes balls, water wings, floatation devices, masks, snorkels, fins, diving objects, etc.
· No flip or somersault dives permitted.
· Diving permitted only in waters deeper than five feet.
· Diving and jumping, in the 9 feet, occur only at the wall near the flagpole.
· No tag games allowed without lifeguard permission.
· No swearing or use of obscene gestures permitted.
· Use of bikes, skateboards, roller skates, roller blades, etc. not permitted within the enclosed pool area. All bikes etc. are to be parked in the bike rack or on the grass. No bikes are to be parked on the sidewalks leading to the pool.
· Parents must accompany children who cannot swim in the pool and be within arms length at all times.
Water Basketball Rules
· Do not hang on the rims of the water-basketball equipment.
· Do not bounce ball on deck surface.
· Limit play to inside the pool.
· Ball stays in the pool at all times
· NO PLAYING or THROWING FROM OUTSIDE THE POOL AT ANYTIME!
· Take turns. Let interested parties participate.
IMMEDIATELY REPORT TO THE POOL MANAGER OR LIFEGUARD-ON-DUTY ALL ACCIDENTS OR INJURIES THAT OCCUR ON THE POOL PREMISES, NO MATTER THE SEVERITY. The Pool Manager maintains a first aid kit in the pool office at all times.
Penalties
Serious or repeated violations of any of these rules will result in restrictions or sanctions on the use of the pool facilities up to and including denial of use.
Disclaimers
The Pool Manager, lifeguards, and/or such persons as designated by the Trustees have been charged with operating the pool facilities and enforcing the rules and regulations pertaining to the use thereof in a manner which best serves the interests of the Pinegate community.
While everyone involved will use prudent and reasonable precautions to ensure the safety of persons using the pool, the Pinegate Homeowners’ Association Inc., its’ officers, trustees, business associates, and/or employees assume no responsibility in the case of an action, injury, death, or loss of personal property.
The Pinegate Homeowners’ Association, Inc. reserves the right to change, alter, revise and/or amend these rules and regulations at any time in the interest of the safety, health, and well-being of Members and their guests.
Definitions
“Members” means homeowners as defined in the Pinegate Homeowners’ Association By-laws.
“Homeowner” – synonymous with Member.
“Member in good standing” - one who has paid their dues to the satisfaction of the Pinegate Treasurer and who has no other pending sanction.
“Immediate family member” - all persons permanently residing in the Member’s home or children of a member of the household that may reside in the Member’s home from time-to-time (such as college students).
“Guest” - any person not an immediate family member.
“Trustee” - any of the current members of the board of the Pinegate Homeowners’ Association.
“Pool Manager” - person or organization engaged by the Pinegate Homeowners’ Association to manage the day-to-day activities of the Pinegate pool.
“Lifeguard-on-duty” means the person or persons scheduled by the Pool Manager to carry out the day-to-day operation of the pool facilities.
