TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11130 SO AS TO PROVIDE THAT ANY STATE AGENCY OR POLITICAL SUBDIVISION OF THE STATE REQUIRED BY LAW TO ENFORCE NATIONALLY RECOGNIZED BUILDING CODES SHALL DETERMINE THE EDITION OF THE CODE TO ENFORCE AND TO PROVIDE EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

“Section 11130. (A) Notwithstanding any other provision of law, a state agency, board, commission, or executive department or office or a political subdivision of the State required by law or regulation to enforce nationally recognized building codes shall determine the edition of the building code to adopt and enforce.

(B) This section does not apply to the Judicial Department or the General Assembly.

(C) For purposes of this section, ‘nationally recognized building code’ or ‘building code’ means mechanical, gas, or fire codes which are part of the International Building Code Series or Standard Building Code Series, as published, promulgated, or made available by the South Building Code Congress International, Incorporated, the energy code as published by the Council of American Building Officials, and the National Electrical Code and Fire and Life Safety Code, as made available by the National Fire Protection Association.”

SECTION 2. This act takes effect upon approval by the Governor.
