Annex 5 – The Supplier’s description of Cloud Services, related support services and consultancy services and the Suppliers Standard Terms for the provision of Cloud Services, related support services and consultancy services

1.  Introduction

This Annex 5 contains the Supplier’s description of the Cloud Services, related support services and consultancy services, cf. section 2 below and the Supplier’s Standard Terms for the provision of Cloud Services, related support services and consultancy services, cf. section 3 below.

2.  Description of Cloud Services, related support services and consultancy services

2.1 Description of Cloud Services

[To be completed by the tenderer.

The tenderer shall briefly describe the following concerning the Cloud Services:

A description of the Cloud Services (SaaS, IaaS, PaaS and FaaS) offered by the tenderer under the Contract, including relevant

technical information on primarily FaaS, object storage, database and indexing, network, technical security, identity, containers, computers and storage, messaging, cloud management and API’s, monitoring and logging, fault tolerance, scaling and data lake/data warehouse,

ISO certificates connected to the Cloud Services,

Information on the Supplier guarantees concerning availability, and

Other relevant technical information and facts on the Cloud Services offered by the tenderer.

The information provided in this section serves an informative purpose as to the Cloud Services provided by the Supplier, but has no impact on the contracting authority’s evaluation of the tender, cf. section 5.6. and 5.7. of the Instructions to Tenderers.

The tenderers are made specifically aware not to submit any descriptions of Cloud Services, which may conflict with the fundamental elements of the tender documents, e.g. Mandatory Requirements including the provisions of the Contract.

The descriptions may consist of the tenderer’s standard product descriptions, e.g. data sheets or equivalent.

The contracting authority would prefer, if the descriptions of the tenderer’s Cloud Services made in this section do not exceed 12-15 pages.]

2.2 Description of support services

[To be completed by the tenderer.

The tenderer shall briefly describe the following concerning the support services:

A description of the support services relevant to the Cloud Services offered by the tenderer under the Contract. The description shall correlate to the support services priced by the tenderer in Annex 2.

The information provided in this section serves an informative purpose as to the support services provided by the Supplier, but has no impact on the contracting authority’s evaluation of the tender, cf. section 5.6. and 5.7. of the Instructions to Tenderers.

The tenderers are made specifically aware not to submit any descriptions of support services, which may conflict with the fundamental elements of the tender documents, e.g. Mandatory Requirements including the provisions of the Contract.

The descriptions may consist of the tenderer’s standard product descriptions, e.g. data sheets or equivalent.

The contracting authority would prefer, if the descriptions of the tenderer’s support services made in this section do not exceed 10-12 pages.]

2.3  Description of consultancy services

[To be completed by the tenderer.

The tenderer shall briefly describe the following concerning the consultancy services:

A description of the consultancy services (Consultant and Senior Consultant) related to the Cloud Services offered by the tenderer under the Contract. The description shall correlate to the consultancy services priced by the tenderer in Annex 2.

The information provided in this section serves an informative purpose as to the consultancy services provided by the Supplier, but has no impact on the contracting authority’s evaluation of the tender, cf. section 5.6. and 5.7. of the Instructions to Tenderers.

The tenderers are made specifically aware not to submit any descriptions of consultancy services, which may conflict with the fundamental elements of the tender documents, e.g. Mandatory Requirements including the provisions of the Contract.

The descriptions may consist of the tenderer’s standard product descriptions, e.g. data sheets or equivalent.

The contracting authority would prefer, if the descriptions of the tenderer’s consultancy services made in this section do not exceed 10-12 pages.]

3.  Standard Terms

[To be completed by the tenderer.

The tenderer shall complete this Annex 5 with the tenderer’s Standard Terms.

The Standard Terms shall cover all Cloud Services, related support services and consultancy services covered by the Contract. The Standard Terms may be inserted here or enclosed as a sub-annex to this Annex.

The tenderers are specifically made aware not to submit standard terms, including service level agreements, which may conflict with the fundamental elements of the tender documents, e.g. Mandatory Requirements including the provisions of the Contract.

By submitting the tender, the tenderer agrees that in case of any conflict between the submitted Standard Terms, cf. this Annex 5, and the Contract clauses 3-15, the Contract clauses shall prevail.

In the event of conflict as described above, the contracting authority will disregard any terms in the Standard Terms submitted by the tenderer that are in conflict with the above mentioned Contract clauses. The tender submitted will as such be binding on the tenderer on the aggregate terms, i.e. the terms of the tender documents and the terms of the remaining parts of the tenderer’s tender (the parts that are not in conflict with the above mentioned Contract clauses), without any further changes of the tenderer’s tender.
