b.It shall be prohibited:

15.To land or take off with any type of aircraft on any lands and waters under the control of the Division of Parks and Outdoor Recreation, except on designated take-off or landing sites AS SPECIFICALLY AUTHORIZED BY THESE REGULATIONS or in case of emergency. “Aircraft” means a ANY device OR EQUIPMENT that is used or intended to be used for manned flight in the air OR TO OTHERWISE HOLD HUMANS ALOFT FOR ANY PERIOD OF TIME, including powerless flight, AND SPECIFICALLY INCLUDES, BUT IS NOT LIMITED TO, AIRPLANES, HELICOPTERS, GLIDERS, HOT AIR BALLOONS, HANG GLIDERS, PARACHUTES, PARASAILS, KITE BOARDS, KITE TUBES, ZIP LINES AND OTHER SIMILAR DEVICES OR EQUIPMENT.

Basis and Purpose

In recent years, manufacturers have designed and merchandised a variety of “extreme” sports equipment meant for new and exciting outdoor activity, including devices that lift the user into the air over land or water, either by mechanical means or self-propulsion.

Visitors and park staff alike would benefit from concrete regulation language that addresses the use or prohibition of use of this equipment. The current regulation is ambiguous and has been interpreted in differently by users and within the agency by different parks.

The proposed amendments in this regulation are public safety measures intended to protect members of the public from threats posed by persons dropping onto the land or water surfaces of a park while other persons are recreating on those surfaces, and to otherwise avoid conflicts between user groups.

#101 – SPECIAL ACTIVITIES REQUIRING PERMITS

B.PUBLIC OR NONPROFIT SEARCH AND RESCUE ORGANIZATIONS SHALL BE PERMITTED TO CONDUCT OFFICIAL, SANCTIONED TRAINING ACTIVITIES ON STATE PARK LANDS UPON COMPLETION OF A SEARCH AND RESCUE TRAINING PERMIT APPLICATION AND WRITTEN PARK MANAGER APPROVAL OF THE APPLICATION.

1.THE SEARCH AND RESCUE TRAINING PERMIT APPLICATION SHALL INCLUDE THE FOLLOWING INFORMATION:

A.ORGANIZATION NAME AND ADDRESS;

B.ORGANIZATION REPRESENTATIVE CONTACT INFORMATION INCLUDING NAME AND PHONE NUMBER;

C.DATE, TIME AND SPECIFIC PARK LOCATION OF PROPOSED TRAINING ACTIVITIES;

D.ROSTER OF PARTICIPANTS;

E.NUMBER OF VEHICLES AND ASSOCIATED LICENSE PLATE NUMBERS;

F.TRAINING AGENDA, LESSON PLAN, OR OTHER DESCRIPTION OF PROPOSED ACTIVITY.

2.THE TRAINING PERMIT APPLICATION SHALL BE SUBMITTED TO THE PARK MANAGER AT LEAST 14 DAYS PRIOR TO THE START OF THE EVENT.

3.UPON REQUEST FROM PARK STAFF, PARTICIPANTS SHALL IDENTIFY THEMSELVES AS PART OF THE TRAINING ACTIVITY.

4.UPON APPROVAL OF THE SEARCH AND RESCUE TRAINING PERMIT APPLICATION, THE PARK MANAGER MAY CLOSE THAT PORTION OF THE PARK OR RECREATION AREA USED FOR THE TRAINING ACTIVITY FOR THE DURATION OF THE TRAINING TO THE PUBLIC.

5.PARTICIPANTS OF SUCH TRAINING ACTIVITIES SHALL BE ALLOWED FREE ENTRANCE TO ANY STATE PARK OR RECREATION AREA WHILE ENGAGED IN THE TRAINING ACTIVITY.

BASIS AND PURPOSE

The Division recognizes and encourages the benefit of allowing Search and Rescue organizations to conduct official training exercises on State Park lands. Coordination between park staff and SAR organizations fosters interagency cooperation, familiarizes SAR staff and volunteers with park facilities and terrain, and ultimately enhances the safety of park visitors.

To maximize a Search and Rescue organization’s training opportunities while minimizing disruption to park visitors, the park manager will review the SAR organization’s training permit application and coordinate with the organization representative to plan and structure the activity.

#700 – VEHICLE PASS

9.A NO FEE PASS SHALL BE ISSUED TO ANY VEHICLE TOWED OR CARRIED IN BY A MOTOR HOME IF A CAMPING PERMIT OR PROOF OF A CAMPSITE RESERVATION IS PRESENTED AT AN ATTENDED VISITOR CENTER, OFFICE OR ENTRANCE STATION. THE NO FEE PASS, VALID FOR THE SAME TIME PERIOD AS THE CAMPING PERMIT OR CAMPING RESERVATION, SHALL AUTHORIZE ENTRANCE BY MOTOR VEHICLE TO THE STATE RECREATION AREAS AND STATE PARKS BY THE USER AND ALL PASSENGERS IN THE MOTOR VEHICLE TO WHICH THE PASS IS AFFIXED. FOR THE PURPOSE OF THIS REGULATION, MOTOR HOME MEANS A VEHICLE DESIGNED TO PROVIDE TEMPORARY LIVING QUARTERS AND WHICH IS BUILT INTO, AS AN INTEGRAL PART OF OR A PERMANENT ATTACHMENT TO, A MOTOR VEHICLE CHASSIS OR VAN.

BASIS AND PURPOSE

Prior to 1994, all vehicles operated in a state park, including those towed or carried in and

later detached and driven were required to purchase and display a valid park pass.

In 1994, an operational procedure within the Division’s Revenue Manual allowed visitors

with a towed to carried vehicle to either transfer a daily pass from the recreational vehicle

to the towed vehicle or display the camping receipt and annual pass receipt on the

dashboard of the towed or carried vehicle.

In 2006, the operational procedure was revised to address inconsistencies that had arisen

from implementation of the 1994 procedure. Campers frequently failed to either move

the daily or the annual and camping receipts from the recreational vehicle to the towed

vehicle, making re-entry into the park and in-park pass enforcement problematic.

About half of all western state park systems charge a fee for a towed vehicle; the

remainder do not or charge a reduced fee.

The 2006 procedure required that every vehicle, including those that had been towed in

and detached and driven, have a valid park pass. Since then, the Division has received

several complaints from the RVing community. The complaints assert that RV

enthusiasts are subjected to unfair discrimination by having to pay for two vehicle passes,

unlike those campers who tow a fifth wheel or camping trailer.

To address this concern and to enhance efficient park operations, the Division

recommends that all towed vehicles be issued a no fee vehicle pass valid for the duration

of the camping stay.

#701 – INDIVIDUAL PASSES

16.VOLUNTEERS FOR THE DIVISION OF PARKS AND OUTDOOR RECREATION ARE ELIGIBLE FOR A VOLUNTEERPARKPASS WHILE SERVING IN ACCORDANCE WITH A SIGNED INDIVIDUAL VOLUNTEER AGREEMENT AND AFTER DONATING A MINIMUM OF 48 HOURS OF APPROVED VOLUNTEER SERVICE WITHIN A PREVIOUS CONSECUTIVE 12-MONTH PERIOD.

A.A VALID VOLUNTEERPASS SHALL BE ACCEPTED IN LIEU OF A FEE ASSESSED FOR A PARKPASS.

B.THE VOLUNTEERPARKPASS IS VALID FOR ONE YEAR FROM THE DATE OF ISSUE.

C.THE VOLUNTEERPARKPASS IS TRANSFERABLE AND VALID WHENEVER TEMPORARILY AFFIXED TO ANY VEHICLE USED TO BRING THE PASS HOLDER INTO A PARK, OR FOR WALK-IN USE, WHEN IN POSSESSION OF THE ELIGIBLE PASS HOLDER.

17.VOLUNTEERS FOR THE DIVISION OF PARKS AND OUTDOOR RECREATION WHO ARE 64 YEARS OF AGE OR OLDER, REGARDLESS OF THEIR STATE OF RESIDENCE, ARE ELIGIBLE FOR THE SENIOR VOLUNTEER PARK PASS WHILE SERVING IN ACCORDANCE WITH A SIGNED INDIVIDUAL VOLUNTEER AGREEMENT AND AFTER DONATING A MINIMUM OF 48 HOURS OF APPROVED VOLUNTEER SERVICE WITHIN A PREVIOUS CONSECUTIVE 12-MONTH PERIOD.

A.A VALID SENIORVOLUNTEERPASS SHALL BE ACCEPTED IN LIEU OF A FEE ASSESSED FOR A PARKPASS.

B.THE SENIORVOLUNTEERPARKPASS IS VALID FOR ONE YEAR FROM THE DATE OF ISSUE.

C.THE SENIORVOLUNTEERPARKPASS IS TRANSFEREABLE AND VALID WHENEVER TEMPORARILY AFFIXED TO ANY VEHICLE USED TO BRING THE PASS HOLDER INTO A PARK, OR FOR WALK-IN USE, WHEN IN THE POSSESSION OF THE ELIGIBLE PASS HOLDER.

D.SENIOR VOLUNTEER PASS HOLDERS SHALL RECEIVE CAMPGROUND USE PERMITS AT A REDUCED RATE EQUAL TO THE CURRENT ASPEN LEAF PASSHOLDER CAMPING PERMIT RATE, AS SPECIFIED IN REGULATION #705. THIS REDUCED RATE APPLIES TO ALL DAYS OF THE YEAR WHEN SUCH AREAS ARE OPEN, EXCEPT WEEKENDS AND HOLIDAYS. FOR THE PURPOSE OF DETERMINING REDUCED RATE CAMPGROUND PERMIT ELIGIBILITY, “WEEKEND” MEANS THE TIME PERIOD BEGINNING AT NOON ON FRIDAY THROUGH 12 NOON ON SUNDAY, AND “HOLIDAY” SHALL MEAN THE TIME PERIOD BEGINNING AT NOON ON THE DAY PRIOR TO THE LEGAL HOLIDAY THROUGH 12 MIDNIGHT OF THE LEGAL HOLIDAY. THE CAMPING PERMIT REDUCED FEES ASSOCIATED WITH THE SENIOR VOLUNTEER PASS ARE IDENTIFIED IN REGULATION #708.

BASIS AND PURPOSE

Volunteers are an integral part of accomplishing the agency mission. To support volunteer efforts, and to provide an incentive to volunteerism at parks, park employees have developed rewards and recognition programs for dedicated volunteers. For several years, the Division has offered an individual volunteer park pass, although it has not been specifically addressed in regulation.

Approximately 10% of the total number of state park volunteers are at least 64 years of age. In the past, senior volunteers who are Colorado residents and who earned a volunteer pass had to purchase an Aspen Leaf annual to qualify for discounted camping. Implementing the administration of a SeniorVolunteerPass would allow this group to obtain the same camping benefit. Allowing non-resident seniors the same privileges will allow state park staff to recruit and retain senior volunteers who primarily serve as campground hosts. Campground hosts, often non-Colorado residents, serve a critical role in excellent customer service for campers.

#704 – CAMPGROUND USE PERMITS AND GROUP CAMPGROUND USE PERMITS

6.From May first through November thirtieth, the camping minimum night stay for the yurts at PearlLakeSTATE PARK shall be two nights. The minimum night stay for the cabins at MuellerState Park, LARGE CABIN #1 AT SYLVAN LAKE STATE PARK AND HARMSEN RANCH AT GOLDEN GATE CANYON STATE PARK shall be two nights; this applies year round.

BASIS AND PURPOSE

Minimum night stays are a common practice in the lodging industry. The Division has determined that the facilities included in this amendment require additional staff time for adequate cleaning and preparation between guests.

One night stays at cabins frequently result in lost revenue for the Division. If a cabin is reserved for only one night during a weekend, it will usually remain vacant for the other night unless a walk-in visitor books it as first come-first served inside the 3-day reservation window.

Approval of this regulation amendment will result in increased revenue for the Division, since priority would be given to users reserving multiple nights especially on weekends and holidays.

If available, individual nights could be sold at the park on a first come-first served basis inside the 3-day reservation window.

#705 – ASPEN LEAF ANNUAL PASSHOLDERS

2.Individuals possessing a valid Aspen Leaf annual pass shall receive campground use permits at a reduced rate of 50% off, rounded down to the nearest whole dollar all days of the year when such areas are open, except weekends and holidays. For the purpose of determining reduced rate campground permit eligibility, “weekend” means the time period beginning at 12 noon on Friday through 12 noon on Sunday, and “Holiday” shall mean the time period beginning at 12 noon on the day prior to the legal holiday through 12 midnight of the legal holiday. The camping permit reduced fees associated with the Aspen Leaf annual pass are identified in regulation # 708.

BASIS AND PURPOSE

Colorado Revised Statutes allow Parks to charge user fees at our parks and recreation areas and state that these areas “should be financed as much as reasonably possible through revenues derived from the users of such system.” Given this legislative direction, Parks and the Board have aggressively established and periodically increased a variety of user fees to help support the parks system. Such increases have been pursued to balance the need for maximizing fee revenue with the desire to ensure state parks are affordable to the average Coloradoan.

The Division has analyzed its current fees and has identified the fees listed above to generate revenue to assist with the $3.0 million funding shortfall for FY 09-10. If fees are adopted by the Board and implemented by January 1, 2010, revenue can be generated for through the last half of the fiscal year.

#707 - SWIM BEACH PASSES

1.A daily or annual swimbeach pass shall be required for a person to enter the rock Canyon swim beach within Pueblo State Recreation Area.

BASIS AND PURPOSE

The purpose of deleting individual annual swim beach pass is to clean up outdated and unused regulations and bring current regulations in line with current standard operating procedures at the Rock Canyon swim beach.

13.It is unlawful for any person to transfer, sell, or assign any permit issued by the Division of Parks and Outdoor Recreation, including special activity permits, campground use permits, and group picnic area permits.
