  1. PURPOSE

1.1At the Planning Committee Meeting held on 11 February 2010, Members approved (subject to conditions and a signed S.106 agreement) the planning application to ‘demolish rear property & link to front property including separate converted stable block. Construct one, two & three storey nursing home, comprising no. 42 x 1 bed en-suite units, ancillary accommodation & associated parking’ to an existing nursing home at 100 Dunyeats Road, Broadstone.

1.2 The details for the s.106 agreement were set out in the report and in relation to Transportation Contributions stated that a “1.financial contribution of £51,626 (plus administration fee) towards appropriate mitigation across the conurbation and towards the South East Dorset Transport Contributions Scheme Adopted 2009 and Policy T13 of the Poole Local Plan First Alteration Adopted 2004 (as amended by Secretary of State Direction 20th September 2007).” The figure sought was in line with TRICS data used for calculating trips by nursing homes.

1.3Since this resolution on 11 February 2010, the applicants have not signed the S.106 and therefore to date no decision notice has been issued. The applicant has disputed the £51,626 as required by the South East Dorset Transport Contributions Scheme, and has provided Transportation Services with survey data of the expected trip rate increase accounting on the additional 42 bedrooms to an existing nursing home.

2DECISION REQUIRED

2.1To agree the reduction in the Transportation Contribution in light of the data submitted by the applicant, and advice by the Head of Transportation Services and therefore agree to an amended wording within the s.106 to reflect the following:-

“1.financial contribution of £25,213 (plus administration fee) towards appropriate mitigation across the conurbation and towards the South East Dorset Transport Contributions Scheme Adopted 2009, Policy PCS36 and PCS37 of the Poole Core Strategy Adopted February 2009 and Policy T13 of the Poole Local Plan First Alteration Adopted 2004 (as amended by Secretary of State Direction 20th September 2007).”

Thus allowing the applicant to sign the s.106 agreement and a decision notice to be issued.

4FINANCIAL IMPLICATIONS

4.1 If committee do not approve the reduced level of Transportation Contribution, then with the applicant not willing to sign the current level of Transportation Contribution required, the committee will need to give full and justified reason for not accepting the proposed level of transportation contributions, for which the application will be refused.

8CONCLUSIONS

8.1The survey data submitted by the applicant excludes weekends in line with the SEDTC and includes support staff (kitchen, domestic and maintenance) and have included staff which provide activities on the site eg. mobile hairdresser as well as general visitors.

8.2The applicant in submitting his survey data advises that with the additional bedrooms the support staff would be likely to work longer and more regular hours and therefore not increase the number of trips made if new staff were employed. In addition the applicant proposes to have 2 kitchen staff working from 08:00 to 14:30 each day of the week creating no additional trips.

8.3Transportation Services have scrutinised the survey information provided by the applicant and conclude that they do not dispute the evidence submitted by the applicant. It is concluded that the level of contribution as proposed by the applicant (£25,213) is sufficient to mitigate the likely increase in traffic generation.
